SUBJECT: Resolution amending Resolution 07-108

STATEMENT OF ISSUE: Resolution 07-108 is to be amended to remove stipulations
preventing the construction of a concrete driveway in vacated Yarmouth Drive right-of-way.
BACKGROUND: The Board of County Commissioners resolved to vacate right-of-way as
requested by David Michael Graves, the petitioner, during the regular session held the 5th day of
June, 2007. The vacation was granted with the typical stipulations placed on vacated right-of-
way. However, Mr. Graves would like to request that the resolution be amended to remove all
stipulations except that which reserves a full width utility easement for all licensed utility
companies including a stormwater/drainage easement for the County.
OPTIONS: Approve/Disapprove amending Resolution 07-108 without stipulations.
RECOMMENDATIONS: Approve the amendment of a new Resolution to reflect that there are
no stipulations to that portion of vacated right-of-way except that which reserves a full width
utility easement for all licensed utility companies including a stormwater/drainage easement for
the County.
