Sec 447. 605( 1), Fla. Stat. says that " All discussions between the chief executive officer of the public employer, or his or her representative, and the legislative body or the public employer relative to collective bargaining shall be dosed and exempt from the provisions of s. 286. 011." It does not except the requirements of 9 286. 0105, Fla. Stat. Provisions re disability and appeal must also be listed on the notice. I believe the notice should also include who will be in attendance so that it is clear that it falls within the parameters of 447. 605. Please confirm with Mr. Mattimore that I am thinking correctly. Not sure we need the disability and appeal verbage as this is not a public meeting. With that said, always appreciate your input and will add that language to the notice if you believe it is necessary. The restrictions state, among other things, that the lots in the subdivision can be used for residential use only. Due to the fact that the Restrictive Covenants are over 50 years old, and many other legal requirements have never been complied with, more than one attorney' s opinion is that these Restrictive Covenants can be tenninated by filing a suit to quiet title. This would be an expensive process with or without opposition from the neighborhood. However, a majority of the property owners can change these covenants in part or in whole. Eglin Comers, L LC offered a corporate grant of $100, 000 to be paid to the newly fonned Garnier Beach Improvelnent Group upon sale of our four parcels to improve the entire neighborhood as you see fit. Now we need your help. We have enclosed an Amendment To Restrictive Covenants that would have to be signed by the property owner. If 50010 of the property owners in Gamier Beach wilt amend these restrictions, it would only affect the four specific parcels of Lot I through Lot 4. If we file suit to quiet title, the probable result will be to eliminate the Restrictive Covenants on all 250 parcels of the subdivision. Either we tllake a corporate grant to the neighborhood or spend the improvement funds on attorney fees to title. We feel it is in the best interest of the neighborhood and quiet ourselves to work together. We will make ourselves available to answer any questions at the neighborhood meeting this Thursday, Nove111ber 15, at 6: 00 pm to be held at the Grace Tabernacle Church in Mariners Plaza.
