his separation from active duty or after the end of his first mandatory
mili tary service period.
In interpreting this section, the plan administrator will apply uniform rules in
a uniform manner to all employees under similar circumstances.
An employee shall not receive credited service in the case of periods of
absence set forth in subsections. 17- 14( 1) and 17- 14( 2) above, but shal' retain
credited service accrued prior to such absence. Subsection 17 - 14 ( 3) above is
subject to the provisions provided for hereinafter in this section. Upon return to
employment after an approved absence, the employee will again accrue credited
service.
Credited military service - An employee will receive credit for each full year

prior to employment with the city, except that persons employed after December 11,

of years of credit an employee may receive for military service shall be two ( 2)
years.
There is a para~ raph missing here which required that an employee not be
credited with service for which he has not made a contribution. The language was
considered redundant. ***
Failure to return to the employ of the city at the end of any period specified
in subsections 17- 14( 1), 17- 14( 2) or 17- 14( 3) above shall be considered a

purposes of this plan, be deemed a new employee upon re- employment unless he has
accrued a vested interest in accordance with and under provisions of section 17- 17
of this article. In no event shall any duplication of benefits occur.
In order to receive credit for credited service under the provisions of this
section, an employee returning from an absence specified above must have either
left his entire employee contribution, accrued to the date of the beginning of his
absence, on deposit in the fund during his absence or, restored to the fund all
employee contribution, together with interest, withdrawn from the fund, plus interest

accrued at least ten ( 10) years of credited service between age sixty- two ( 62) and
seventy ( 70), but no later than age seventy ( 70), shall, at their request, be retired
on a monthly pension calculated by the method prescribed in a subsequent paragraph
of this section. Each person who meets these requirements shall accru'e a
retirement benefit commencing at normal retirement equal to the percentage as
derived from the following schedule and applied to the final average basic monthly
earnings averaged over the highest five ( 5) consecutive years of last ten (10) years
of employment. The retirement benefits will be calculated as follows:
a) The employee shall be credited with a monthly retirement benefit equal
to two and one- half percent of final average monthly earnings for each
year of credited service but no greater than 100% of current earnings.
Benefits shall begin on the first of the month following retirement.
There is a missing paragraph at this location providing for the facility of paying
retirees in alternate periods other than monthly if their retirement pay is less than
ten dollars ($ 10. 00) or five dollars ($ 5. 00), respectively. This was considered moot
since it is now an impossibility for an employee to retire with such a benefit.***

his credited service to his early retirement date, but reduced by one- fourth percent
1/ 4%) for each 30. 4375 days that such early retirement date precedes the
employee' s normal retirement date.
If an employee who has terminated under the provisions of section 17 - 17 with
a deferred vested accrued benefit has met the age and service requirements of this
section, he may also change his election to early retirement in lieu of receiving the
