Page 3 of 7 CRA 03- 07- 07 ALTAVISTA- EXTENSION OF SITE PLAN ( CONT) 2. Prior to granting a Certificate of Occupancy the condominium association documents shall be reviewed and approved by the City Attorney, and shall provide guarantees for continued maintenance of all common areas and a restriction on the use of the 24 units as transient lodging units unless adequate parking ( 2 spaces per unit) is provided for permanent residential uses. Mr. Covey seconded motion. Mr. Rettie provided written comments to the Board and Staff outlining his concerns in reference to the supporting documents provided by Staff for the Altavista project. Comments included the disorganization of the package; the lack of written minutes of the DRC meetings; and comments regarding parking for the project. The City Attorney advised Mr. Rettie that this is a quasi-judicial proceeding and the only issue being considered is the extension of the site plan for the Altavista. The City Attorney stated that the only way the concerns Mr. Rettie discussed would be addressed is if the Development Order expired completely and the applicant had not come forward for an extension. She stated that while many of his comments made regarding the package itself may be relevant to what is being discussed, a lot of the items regarding the specifics of the site plan and the approval process are not. The City Attorney corrected that the DRC Committee is required to make a record of its findings and process gone though and document it, and noted several memorandums are in the package from the various departments and these memorandums serve as documentation of the findings of the DRC Committee. Mr. Reed called for the question for the vote on the motion and it carried unanimously with Sobo, Covey, Pagliari, Reed, and Rettie in favor (Gossom and Kennedy absent). Mr. Reed commented that Staff is accessible five days a week and if anyone has questions or concerns they can contact Staff and have questions clarified rather than taking time at a public meeting. It was recommended that new members direct any questions or corrections they have to Staff beforehand. REQUEST TO A ENDMENT TO SITE PLAN- PRESIDIO CONDOMINIUM Consideration of mendment to the site plan for Presidio Condominium located at 124 Miracle Strip Parkway. The City Attorney swore in tho Blinn Van Mater of BVM Architects ' sed the amendment consists of an elevated pool deck with a retaining wall at 19. 6 NGVD, 001 deck area approximately 9% larger, and a commitment to build that portion of the boa alk adjacent to the pool deck. Mr. Van Mater explained the amendment is necessary due to anges in flood standards which require the pool to be elevated. Mr. Rettie questioned whether the site plan in package is the one that was a site plan from the City' s previously approved by the Council. He stated he picked Engineering Division which shows that something is being built ov the water, and questioned the legalities of building over the water. Page 4 of 7
