ORDINANCE NO.: 1407 AN ORDINANCE OF THE CITY OF FORT W ALTON BEACH RELATING TO THE CONVEYANCE OF REAL PROPERTY OWNED BY THE CITY AND CONSISTING OF 0. 34 ACRES +, IN EXCHANGE FOR REAL PROPERTY TO BE OWNED BY THE SHOPPES AT PARADISE POINTE, LTD., A FLORIDA LIMITED PARTNERSHIP, CONSISTING OF 0. 003 ACRES+ AND A SIDEWALK AND CITY SIGN EASEMENT; PROVIDING FOR AUTHORITY; PROVIDING FOR FINDINGS OF FACT; PROVIDING FOR CONVEYANCE OF THE SUBJECT QUITCLAIM DEED; PROVIDING FOR PARCEL BY ACCEPTANCE OF A QUITCLAIM DEED AND GRANT OF EASEMENT; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT W ALTON BEACH, FLORIDA: SECTION 1. AUTHORITY. The authority for this Ordinance is Section 166. 021, Florida Statutes. SECTION II. FINDINGS OF FACT. The City Council finds and detennines that it is in the best interest of the City that the City convey the real property described herein in the QuitClaim Deed from the Cityto The Shoppes at Paradise Pointe, LTD., in exchange for the real property described herein in the Quitclaim Deed from The Shoppes at Paradise Pointe, LTD., and a Sidewalk and Sign Easement. The best terms have been negotiated and the proposed utilization of thepropertiesand their development are for uses benefiting the City and its citizens. SECTION III. REAL PROPERTY EXCHANGE APPROVAL. The exchange of the real in EXHIBIT 1 attached hereto and property owned by the City and specifically described incorporatedherein reference is by exchanged for and in consideration of the real hereby LTD., and specifically described in property owned by The Shoppes at Paradise Pointe, in EXHIBIT 2 attached hereto and incorporated herein by reference and further for and Pointe, consideration of the easement granted over property owned by The Shoppes at Paradise LTD., and described in EXHIBIT 3 attached hereto and incorporated herein by specifically reference, is hereby approved. SECTION IV. FORM OF CONVEYANCE AND ACCEPTANCE.
