REZONE FROM C- 2 TO REQUEST: Rezone from C- 2 to R- 2, Lots 1 through 10 inclu-
R- 2, LOTS 1- 20 & siye (facing Bass Avenue), and Lots 14 through 20 inclusive
LOTS 14- 20, BLOCK 1, facing Beal Parkway), Block 1, Beal' s Addition to Fort
BEAL' S ADDITION Walton. ( Devon D. Pelham).
Bass Ave & Beal Pkwy
PLANNING BOARD recommends the request be denied due to the
fact there is no R- 2 zoning contiguous to this property.
There is R1- A property at Third and Bass. It is recommended
that Council look into the situation and make the final
decision as to the rezoning. There was no one present at
the public hearing against the rezoning, also there is some
of the commercial zones being maintained as residential at
present.
Mr. Bauglnnan asked if the Attorney could give a ruling as
to whether it would be spot zoning.
Mr. Franklin moved that the rezoning request be approved
from C- 2 to R- 2. Mr. Bishop seconded the motion.
Mrs. Thornber stated that thiS had come up before where they
had wanted to rezone and it came out spot zoning and yet
what the people want is the best use of the land. She

1, BEAL' S ADDITION City Attorney stated yes. He stated that the problem was in
Con' t) the Comprehensive Plan. He stated that he had suggested to
Mr. Campbell and Mr. Spencer who is developing the project
that they need to be alert for the Comprehensive Plan. He
stated that he was told that the land was zoned commercial in
the Comprehensive Plan. He stated that if it was, then the
I
law says when you change zoning there you change the Compre-
hensive Plan and then change the zoning or do it stmulta~
neously. He stated there was a Comprehensive Plan amendment
procedure, you can' t do it tonight, you have to give the same
kind of notice as you just gave for the zoning changes you
were making for the RDA. Mrs. Thornber inquired whether they
could start the procedures tonight or not. The Attorney
stated that would have to come through the Planning and Zoning
Commission.
Mr. Franklin withdrew his motion. Mr. Miller asked what the
Comprehensive Plan provided for this property. Mr. Bishop
stated that this should be looked at because you could end up
with someone.' buitding townhouses with something incompatIble
in. commercial.
Mr. Franklin stated that if the councilmembers would take a
look at present zoning map, they
our would see very close to
this property some R~lA zoning, M- 1, and C- 2 and C- 1 zoning.
The only thing he could say in favor of the project is that it
would improve the neighborhood, increase the tax rolls and
be beneficial to the citizens of Fort Walton Beach.
Mrs. they go back to the Planning and
Thornber moved that
Zoning Board to it
see if
is in agreement with the Comprehen-
sive Plan and if not to go through the public hearings and
change it. Bishop seconded the motion.
Mr. Mr. Miller said
to wait and see what the
Comprehensive Plan says. Mr. Miller
moved that they temporarily pass the item and go on to the
order of the day.
City Attorney stated that by what he could tell by the Com-
prehensive Plan you do have a commercial area. That means you
need to change the Comprehensive Plan.
Thornber moved that they return the item back to the
Planning Board. Mr. Bishop seconded the motion with the
restriction that the whole area be looked at not just certain
I
pieces. Mrs. Thornber saId,. they. needed to add that
