164. 2 RE: SOLICITORS 164. 2 AN ORDINANCE AMENDING SECTION 16- 9
ORDINANCE OF THE CODE OF ORDINANCES OF THE CITY OF
FORT WALTON BEACH PERTAINING TO SOLICITORS
PROVIDING THE EFFECTIVE DATE HEREOF.
City Attorney read the ordinance and
explained it. Mr. Rigdon stated that he
gets calls from allover the United States.
I think it is hard for us to pass an
ordinance like this. We put an ordinance
on the books that says you can' t solicit
after certain hours. It' s kind of silly
to try to enforce something like this.
I
City Attorney stated that we now have in
the ordinance section which prohibits
a
telephone solicitation, and people call
anyway. If we take that out, I guess
they' ll just call more.
Mr. Roy Ourso asked if this would pertain
to political candidates calling to solicit
votes. City Attorney replied that this
pertains to solicitation of funds or the

sale of products.
Mr. Hunt stated that the problem is that
if you have someone calling from outside
the City, there is not much you can do
about it anyway.
Mr. Baughman asked if this could be handled
by complaint called in by the person who
a
received the call. City Attorney explained
that there have been cases where telephone
solicitation has been stopped inside City
limits. A problem you have is people cal-
ling on a toll- free number from out of town,
you have no way of finding out who is calling.
It is up to Council, but this is a very
hard thing to enforce.
City Manager explained that if you pass
the ordinance, you are limiting door to
door solicitation to 8: 00 a. m. to 6: 00
P. m. and eliminating the prohibition of
telephone solicitation completely.
Mr. Hunt moved that the ordinance be appro-
ved. Motion was seconded by Mr. Rigdon,
and Mayor called for discussion.
Mr. Baughman asked if Council would con-
sider changing the hours from 8: 00 to
6: 00, to 8: 00 to 5: 00.
Mr. Rigdon stated that he is in favor of
moving it back to 4: 00.
City Attorney explained the ordinance
again and said that solicitors must get
a permit, and then they can solicit between
the hours of 8: 00 and 6: 00. Section 2
of the old ordinance prohibited telephone
solicitation. This ordinance is repealing
that section.
City Manager stated that if it is the 1 j
intent of Council that telephone solici- j
I
tation be allowed between the hours of 1

8: 00 a. m. and 6: 00 p. m., then let' s state I
