READINT( G- 4T DATE 1st 2nd ORDINANCE 1846 AN ORDINANCE OF THE CITY OF FORT WALTON BEACH, FLORIDA, PROVIDING AUTHORITY & INTENT; AMENDING CHAPTER 15, ZONING DISTRICTS, OF THE LAND DEVELOPMENT CODE, BY PERMITTING AUTO PARTS SALES WITH NO INSTALLATION IN THE MIXED USE COMMUNITY COMMERCIAL — 2 DISTRICT; AND SETTING AN EFFECTIVE DATE. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WALTON BEACH, FLORIDA, THAT THE CODE OF ORDINANCES OF THE CITY OF FORT WALTON BEACH IS AMENDED AS FOLLOWS: Section 1. Authority & Intent A. The authority for enactment of this ordinance is contained in Chapter 166.021, and other provisions of the Florida Statutes and section 2 of the City Charter. B. The Municipal Planning Board, sifting as the Local Planning Agency, held a public hearing and considered this ordinance on December 2, 2010. The City Council conducted public hearings on JC4% Aaf 9,5 2011 and Fe'tar ai 2011, after giving due public notic . C. The City Council finds that permitting " Auto Parts Sales With No Installation" is consistent with the Comprehensive Plan of the City of Fort Walton Beach. Section 2. Amendment of Table 15 -2 Chapter 15, Zoning Districts, of Volume V, Land Development Code, is hereby amended to permit, " Auto Parts Sales with No Installation" in the Mixed Use Community Commercial -2 ( MUCC -2) District only, as listed in Table 15 -2. Section 3. Conflicts All ordinances or parts of ordinances in conflict with this ordinance are repealed to the extent of such conflict. Section 4. Severability If any word, phrase, sentence, paragraph or provision of this ordinance or the application thereof to any person or circumstance is held invalid or unconstitutional, such finding shall not affect the other provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application, and to this end the provisions of this ordinance are declared severable. Section 5.
