JUDICIAL HEARINGS --Consideration of a Development Agreement for Landmark
The City Attorney announced a quasi-judicial proceeding and gave the oath to those who
planned to participate. There was no ex -parte communication from Council regarding this item.
Tim Bolduc, Engineering/ Utilities Services Director, presented an overview on the history of the
Landmark from 2007 to the present. Mr. Bolduc informed that after much discussion with the
developers, the City received a revised version of the Development Agreement in December
2013, and after a review, the developers and Staff agreed it would be appropriate to nullify all
existing agreements, memorandum, and orders and begin with a new Development Agreement.

Regular Meeting Minutes
January 14, 2014
Mr. Bolduc explained this decision was based on the inability to make the new request and the
original agreement comply under the new direction of the project.
Mr. Bolduc discussed the major proposed terms and conditions of the new Development
Agreement,
including rendering void all terms and conditions of previously approved
agreements, orders, and memorandums; that it does not commit the City to purchase any parking
spaces but proposes to transfer the adjacent City property to the developer, who will then provide
and make available at least 119 parking spaces; there is no condominium arrangement proposed;
and the Developer may apply for grant assistance through the CRA but approval is not
guaranteed.
Mr. Bolduc advised the Developer will own, manage, operate and maintain the parking facility at
their expense in perpetuity, and the developer must apply for a Development Order and
associated building permits within six months of City Council approval of the Agreement.
Valerie Wenzel, property owner at 201 Miracle Strip Parkway, received clarification that the
City will have the same number of parking spaces under the new agreement.
The City Attorney informed that this is the first of a minimum of two public hearings on this
issue, and that a decision is not needed by Council this evening. It was announced the
Development Agreement will be discussed and placed on the agenda for the January 28, 2014
Council meeting.
Council noted renewed discussion of the bridge issue and this could be a concern in the future.

MEMBERSHIP REAPPORTIONMENT PLAN FOR THE FORT WALTON BEACH -
NAVARRE-WRIGHT URBANIZED AREA; AND PROVIDING AN EFFECTIVE DATE.
The Mayor read Resolution 2014 -01 by title.
The City Manager reported the resolution was placed on the agenda at the request of the
Okaloosa -Walton Transportation Planning Organization ( OWTPO). He explained that every 10
years the OWTPO reviews the apportionment of its voting members based on population, and
due to a decrease in the population of Fort Walton Beach, it has been proposed that the City's
voting apportionment be reduced to 2 votes from its current 3 votes.
The City Manager informed that Staff is not recommending approval of the resolution as the City
is projected to lose one voting member.
Mr. Rynearson stated he is a member of the OWTPO and has been involved in the discussions
the past several months and is not opposed to the resolution.
Mr. Rynearson moved to adopt Resolution 2014 -01. Ms. Jamieson seconded motion and it
carried by a vote of 4 to 2.
