Resolution 07- 01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FORT WALTON BEACH RELATING TO STOKES AVENUE PUBLIC IMPROVEMENTS AND ASSESSMENT; ACCEPTING THE COMPLETED CONSTRUCTION OF WATER, SANITARY SEWER, STREET AND DRAINAGE IMPROVEMENTS ON STOKES AVENUE IN THE CITY OF FORT WALTON BEACH; REVISING THE TOTAL SPECIAL ASSESSMENT TO THE ACTUAL COST OF $ 218,730. 25; APPROVING THE REVISED FINAL ASSESSMENT ROLL; ALLOWING ASSESSMENT BE PAID WITHOUT INTEREST AT ANY TIME WITHIN 30 DAYS AFTER THE PASSING OF THIS RESOLUTION; DIRECTING THE FINANCE DIRECTOR TO ISSUE APPROPRIATE BILLING; PROVIDING FOR AN EFFECTIVE DATE HEREOF. WHEREAS, the City Council of Fort Walton Beach passed Resolutions 05- 13, 05- 32 and 05- 34 determining public improvement by special assessment; declaring water, sanitary sewer, street and drainage improvements on Stokes Avenue in the City of Fort Walton Beach; and WHEREAS, a Public Hearing was properly advertised and held before the City Council on October 25, 2005; and WHEREAS, following the Public Hearing the City Council met as an Equalizing Board to hear and consider any and all complaints as to the special assessments and so adjusted and equalized the assessments on a basis of justice and right; and WHEREAS, the City Council approved the total public improvement special assessment of 222, 049. 82 may be paid in twenty ( 20) equal annual installments at an interest rate of five percent 5~) perannum; and WHEREAS, installation and construction of said improvements have been completed and the Final Assessment Roll, as approved in Resolution 05- 34, has been revised crediting each of the assessments, where less than the original assessment, the difference in the assessment as originally made, and confirmed and the proportionate part of the actual cost of the improvements to approved be paid by special assessments as finally determined upon the completion of the improvements. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WALTON BEACH, FLORIDA:  SECTION I: The City of Fort Walton Beach accepts, as completed, the water, sanitary sewer, street and drainage improvements on Stokes Avenue in the City of Fort Walton Beach, in accordance with the plans and specifications previously submitted to and approved by City Council and as amended during the process of the work. SECTION II: The total public special assessment shall be revised, crediting each of the assessments the difference in the original assessment and the proportionate part of the actual cost, where less than the original assessment, of the special improvements, excluding the costs of City staff services and attorney services, for a total public improvement special assessment of 218, 730. 25. SECTION III: The City of Fort Walton Beach approves the special assessment for the water, sanitary sewer, street and drainage improvements on Stokes Avenue in the City of Fort Walton Beach, in accordance with the Revised Final Assessment Roll ( Exhibit " A"), revised by Section II above, and designated by the Assessment Plat ( Exhibit " B"), which are attached and made a part hereof. SECTION IV: The special assessment shall be paid without interest at any time within 30 days after passing of this resolution, or with interest under the installment terms established by Resolution 05- 34. SECTION V: The City of Fort Walton Beach Finance Director shall proceed with the issuance of the appropriate billing, in accordance with the attached Revised Final Assessment Roll. SECTION VI: This resolution shall take effect upon approval by City Council and signature by the Mayor.
