267 Briarwood Circle, com-
mented the
calls made to Mv. Hedrick and
on
asked if he had said that renting a large hall
unless they came up with something different
wouldn' t change his mind even if large number
of people were there.
Mr. Hedrick said he thought if everyone had
a chance to be here and reason he suggested
to the Mayor renting the biggest hall in town.
Mrs. Williams asked again if he commented that
didn' t make any difference how many people
were there.
Mr. Hedrick said he didn~t say that, but some
evidence more than had here. He noted the
two panels neither of which he had attended;
saying he understood this had been going on,
and had been made a career of; he said he
voted as they knew. He said he had no apolo-
gies for doing it. He said anybody could be

Mr. Hedrick said that was neither here nor there; that
he could change his mind on it.
Mrs. Williams asked if numbers would influence him
if they were in favor of a referendum.
Mr. Hedrick said he would be for it.
1 Someone
again
did not give their name asked Mr. Brock
the
who
motion and he repeated it again ( from
about
the corner of Wright Parkway on Virginia Drive to
the SW corner of the cemetery or from SW corner of
cemetery all the way down Lake & Virginia Drives -
all the way to Wright Parkway).
Someone in the audience commented that the motion
didn' t include Wright Parkway.
Floyd Bullock saidmember of Council had said
one
he had no rights his property whatsoever and he
to
would like this clarified from the City Attorney.
Attorney commented that Mr. Bullock would do a lot
better get independent legal advice that he was
to
not familiar with the facts to give him an opinion
on it.
Mrs. Shultz, BriarwoodCircle, remarked on the beauty
of Beal Street since the 4- laning and objected to
apartments and commercial zoning.
Mrs. Harvey of Briarwood Circle commented that the
reason the audience was angry was because they felt
principles of democracy were being4aaedi: m9cklery. of .here.
She commented that Council was elected by about 23%
and asked if the group present was 23% of the resi-
dents of the area in debate and if they were, then
they were as much of a majority and they had expressed
their reasons and said they had not heard Council' s
reasons for voting - saying Council was not responding
to them.
Mr. Rigdon said he still thDught it was wrong to
rezone the property; create hazard and he thought
Council should reconsider. He said these people
jA
didn' t want rezoning
the and when a majority of a
neighborhood comes down and takes a stand against
zoning in their community they should recognize
them; saying again he felt Council should reconsider,
and deny this request.
Phil ( didn' t get last name) who said he lived in
Cinco Bayou, Number 243, commented on the current
condition of Cinco Bayou and asked Council to consider
94
ecology, and traffic on Beal, asking if City could
add to police force.
Henry Fisher of .Gap Creek Drive mentioned a master
plan as to the future growth and development of an
orderly city and asked why rezoning was necessary.
Mr. Buskirk asked if a traffic survey hadn' t
Van
been at Memorial and Beal for traffic light
done
and was turned down because trafficcwas not heavy
enough for traffic light.
Gene Hendrix, corner of Memorial and Beal said Mr.
o
Van Buskirk didn' t know what he was talking about.
Mr. Van Buskirk repeated that State had surveyed the
problem.
Millie Williams, Briarwood Circle, assumed that the
three people who owneQ the property bought it for
speculat, ing as residential property and naturally
didn' t stand to make as much money if developed
residential, but they could make some money and
the City could make some money and it wouldn' t
be a total loss.
Someone who did not give their name asked if a survey
had been made of estimated change in property values.
Mayor answered not to his knowledge.
Mayor asked what the wishes of Council were.
Mr. Van Buskirk stated he believed that they had
covered enough and moved that Council move on to
other business. Motion seconded by Mr. Brock and
vote was aye unanimously.
RECESS Mr. Van Buskirk then moved for a 5 minute recess.
Motion seconded by Mr. S~ hweizer and carried unani-
mously.

was
Drive objecting
dder and
RayTl!\
to Ordin-
lots on Cape Drive from R- IA
He noted this ordinance
being passed in opposition to the recommenda-
tions of the zoning commission because it was spot
zoning. He noted the definition of spot zoning
and the fact that spot zoning was illegal. He said
he didn.' t think Council ought to put the people in
position to go to court to stop action which it
knows is illegal. Area was pointed out on the map.
Mr. Middleton felt other rezoning on Memorial had
been done simply because it was a busy street and the
area was one lot deep. He said these lots were
useful for R- IA residences because they are build-
ing right now. He also noted that the street is
not paved yet. He asked Council to set up a plan
people could rely on and said this action was highly
improper.
ORDINANCE Mayor asked the City Attorney to read the ordinance:
100. 158
ORDINANCE 100. 158 REZONING FROM R- IA, LOTS 11 thru
14, BLOCK 3, iCXKLAND 04
Mayor then asked if the property owners were present
who asked for the rezoning.
Mr. Buskirk asked, about the location of the other
Van
apartments on Cape Drive and they were pointed out
on the map. ,
Mr. Riggon then movedt1)at Ordinance 100. 158 be
denied. Motion seconded by Mr. Brock.
