Mrs. Battle moved the adoption of Ordinance 856 on second reading. Motion was seconded by Mr. Patrick. Joe Kieszek, 21 Maples Street, NW, owner of Kinetic Bullders, Inc. located at6 Park Circle, SE, on the East 80 feet 11, Block 4, stated there is a of Lot growing concern in that area and objects to the property being rezoned from C- 2 to R- 2 since this will not allow him to expand his business. Mayor , Shortall asked the Public Works Director to give a report on this section. Mr. Tona stated he wanted to know if this type of business would fall into the R- NC. Mr. Jackson stated that it was not cons~dered to be a ' neighborhood type of 'business and that this particular spot was probably overlooked in the reviews that were done. The area south of the lots along Hollywood have been changed to R- 2 and this particular lot was not picked up as a contractor' s location, and felt that it would not be a problem to leave it C- 2. Paul Kieszek, stated he operates out of Kinetic Builders and did not understand why the area is being rezoned for apartments since they do not sell well in that area and felt it would be to the city' s advantage for that area to be commercial and would like to have the opportunity to purchase land to expand his business. 2/ 11/ 86 83 ORD. 856 ( CONT' D.) Charles Shuttle. representing St Mary' s Church, asked why the zoning is changing east of St Mary' s Church. Mr. Jackson stated he spoke to French Brown today, whose main concern was that it was part of St Mary' s property and assured him that it was not. At the that block or land is zoned C- 2 and the I present time area around that piece of property is zoned R- 2. That piece of property could have been zoned R- 2 but, since it is already commercial. decided to leave it R- HC, residential- neighborhood commercial, which would bring it more in line with the residential area than C- 2 and R- HC would not allow as much commercial on that piece of property as C- 2 would allow. There was on this ordinance and Mr. further discussion Jackson suggested that, since this is the first quadrant to be passed. there might be some problems that have not been spotted. and in order not to hold this up to tie into it a mechanism that will allow people six months to one year to come to the staff or the planning board so it could be studied on an individual basischanged to be appropriate to the zoning plus not charge the zoning fee if they do a rezoning in a quadrant that is recommended by staff. There followed a discussion on this recommendation. Mayor Shortall called for the vote on the motion to adopt . Ordinance 856 on second reading. and it was defeated by a vote of 3- 4 with Hr. Smith. Mr. Patrick and Mrs. Battle in favor. and Mr. Rivers, Mr. Bobo, Mr. Tona and Mr. Roberts opposed. Mr. Bobo moved that Ordinance 856 be continued to another agenda. Motion was seconded by Mr. Tona. There was a discussion on whether this Ordinance should be sent to the Planning Board for further consideration and the City Manager requested Council to give direction to starf some on what Council wants done with this Ordinance. Mayor Shortall called for the vote on the motion to continue Ordinance 856 to another agenda. and it was I defeated by a vote of 3- 4 with Hr. Bobo. Mr. Tona and Mr. Roberts in favor, and Hr.
