threw him into a 21 violation of
the front setback line. He is reques-
ting that this be granted. I think
that this is the final assistance needed
from Council to get this project star-
ted.
Mr. Hunt moved that the variance be
granted. Motion was seconded by Mr.
Bishop and carried unanimously.

REQUEST FROM SCHOOL Mayor presented a request from the
BOARD FOR CITY SOFTBALL Okaloosa County School Board for per-
FIELDS mission to use the City Softball Fields
from March 1, 1979 thru May 3, 1979.
Mr. Rigdon moved that the request be
approved. Motion was seconded by Mr.
Hill and carried unanimously.
HEARING PANEL MEMBERSHIP In reference to Hearing Panel Members,
City Manager read
an excerpt from the
City Charter stating that the Hearing
Panel shall consist of seven ( 7) mem-
bers who shall be appointed by City
Council. A majority shall constitute
a quorum for the transaction of busi-
ness.
Mr. Rigdon said, to get in line we
should ask the board to put the names
in a hat and pull one out. I think we
should write the board a letter and tell
them what the problem is and ask them
if they have a solution.
Mr. moved that Council submit a
Rigdon
memo to the board and tell them the
ordinance reads seven members and ask
them if they could come up with a solu-
tion to reduce the membership back to
seven to agree with the ordinance.
Motion was seconded by Mr. Hunt and car-
ried unanimously.
STORM DRAIN AT MADARIS Mr. Baughman said, at Madaris Printing
RPINTING COMPANY those people have been having problems
with a storm drain that is in a bad
location. Several people have damaged
their cars. They are asking for some
help and I wonder if there is anything
we could do to help them.
City Manager explained that Mr. Hill r'\
has talked with them. This is a stan-
dard inlet and the building was cons-
tructed behind the inlet and they broke
the section of curb out themselves and
broke it out right up to the inlet
rather than leave any gradual taper,
so you do have a sharp edge. It can
be made into a flat inlet and there
would be no raised concrete there, how-
ever it would not be as efficient. You
have a choice of a $ 750 expenditure on
the part of somebody, and can make it

a flat inlet so that you donlt have the
raised concrete.
Mr. said, this doesnlt
Baughman involve
just the business, It involves people
who are using the parking lot. I think
I
we should go ahead and do it.
Mr. Rigdon asked if it is on private
prop~ rty.
City Manager said it is on the street
right of way. But it was broken out
wrong in the beginning by the individual.
It should have been left with a taper.
There is room on either side for cars
to cross curb to parking area.
Mr. Rigdon said he would like to see a
cost breakdown, and moved to ask the
engineer for a breakdown of cost. Mo-
tion was seconded by Mr. Baughman and
carried unanimously.
SAND WASH AT BOTTOM OF Mr. Baughman asked if something could
LEE COURTERIS PROPERTY be done about the sand collecting at
the bottom of Lee Courterls property.
City Manager said that we have had some
wash there and it has not been correc-
ted yet, but it will be.
DRAINAGE PROBLEMS ON Mr. Baughman asked if there is anything
CAPE DRIVE the City can do to help the people on
Cape Drive. Several have called me and
evidently we are not going to be able
to pave that street until October.
City Manager replied, Noonan Construc-
tion Co. is laying 30" sewer pressure
main there, and has just completed that
street this week. You have boiling
springs on the south end of that street
that have been cut into there and it
I
is a problem. I talked with Public
Works Director today, and the public
hearing for the assessment roll is set
for April 10. In the meantime we plan
to put in a french drain under the ground
there. There will be $ 2, 000 - $ 3, 000
worth of material. This should dry the
area you are talking about.
Mr. Baughman asked if the paving could
be done any earlier than October.

City Manager said, what we are trying
to work to is to get that road-- there
is a precedent set in the Oakland area.
There is 50% funding for the cost of
paving and no drainage cost. What we
are trying to do to keep you from having
to spend the other 50% out of your
general fund is to target that street
so that it will be ready for asphalt
in October. We have a verbal commitment
from the County to provide the asphalt
out there.
Mr. Baughman asked if the commitment is
firm enough to go ahead and borrow mo-
ney and go ahead and do this and then
get the money back from the County?
City Manager replied that he didnlt think
we could get the County to lay asphalt
that way. They have a machine and an
annual bid with an asphalt plant, and
the only way we can get asphalt from
them is for them to lay it.
YELLOW FLASHING LIGHT ON Mr. Baughman mentioned a problem on
MAIN STREET Main Street for pedestrians. I saw
just the other day two elderly ladies
almost get killed by a car in the mid-
dle of the street. I think we should
ask DOT to come in and put in a yellow
flashing light and
a 20 mph speed zone
near the City park, next to the Mayor' s
store. He moved to write to DOT and
ask them to put in a flashing light
and a 20 mph sign.
Mr. Hunt asked how traffic study is
coming along?
Mr. Ryan replied, that is the Redevel-
opment Commission planning.
