ORDINANCE REFERENCE City Manager asked that the ordinance
CONSTRUCTION PENALTY imposing a penalty for commencing cons-
truction without a building permit be
brought back before Council. Council
passed this some time back and I under-
stood the intent
to be for one who con-
I
tinues to construction without a
start
permit to be penalized. The way it is
written, the Building Inspector is
utilizing it on innocent people, and I
donlt think it was Councills intent to
do that. So to keep the Building Inspec-
tor and myself from having differences
I would recommend that we set up something
to penalize second offenders.
Mr. Rigdon said, that was my recommen-
dation when we set up this thing, and I
agree. It is just a tool, because we
have people who continually violate the
ordinance and we ought to have some way
to penalize them.
Mr. Baughman asked, does that mean that
nobody who commits a first offense would
be penalized?
City Manager replied, there will have
to be some judgment exercised here. You
take homeowner who has never heard of
a
a permit and doing $ 200 worth of work
and slap him with a $ 100 fine, this is
not right, because he does not intend
to do any wrong.
Mr. Hunt said, the penalty was estab-
lished for a reason. It was for the
habitual offender. Is there anything
wrong with us leaving it like it is and
giving you whatever authority you need
to get the proper interpretation over
to the Building Inspection Department?
Mr. Baughman said the builders are
I
really the ones who ought to know, and
I think this is where the real violations
are coming from.
Mr. Hunt said, I disagree. If a man is
in business to build, he is not going to
go out there and violate the law or not
buy a building permit. He knows he is
going to have to have the inspector come
out and inspect it and pass on it.

Mr. Baughman said, the ones I remember
were fences put up by fence companies.
Mr. Hunt replied, that is not a building
contractor.
Mr. Hill said, why donlt we let the
City Manager have the latitude of making
that decision?
Dr. Houghton suggested tabling it
