CPS Under new business Mayor McLaughlin congrat- ulated Mrs. Taylor who had been notified 1 BID RECOMMENDATION that day of her passing the Certified Pro- fessional Secretary examination and had earned the CPS rating. City Clerk asked that Council consider in- cluding the recommendation to refer bids to department heads for recommendations and study in the motions approving the recom- mendations. He noted this was a technical point. 159 Mr. Rigdon saidit was December of 1964 when he was asked to serve as representative on the Gas Board and appointment took effect in January of 1965 to serve and the minutes so state. He said it was his understanding that Council could remove him anytime wanted 1 to when Council had 4 votes or 2/ 3 and if they removed him to give him just cause why. He said he was under the impression and he still said somewhere along the line he was re- appointed 2 years ago. He said this time came up and Council had the right. He said he talked to other members on the board and they were under the impression that he was re- appointed 2 years ago. He said he recalled verbal discussion and had not been found in recommendations. He said if Council elected to remove him from Gas Board under his rights, Section 8 of local bill 1313 he had just cause in asking for a public hearing to prove that he was appointed, that he had two years to seTve on this board and he left it to Counci 1. Mr. Rigdonsaid he looked, to clear the records, and still said Council had the right; he said hedidn' treally want to serve on the Gas Board but was asked, and he went over there and when he did, he learned the system. He said he was in the utility business that the utility system at Eglin was one of the largest in this part of the country. He said he found the City of Fort Walton Beach was not receiving all of its 3% franchise money. He said Council asked him to find out how City could buy their share. He said 47% of the system belonged to Fort Walton Beach. He said he found away Fort Walton Beach could receive revenue and City had received in the neighborhood of $ 200, 000 plus or minus. He said if Council felt he had not done a just job over there or misrepresented Fort Walton Beach only course they had was to remove him. 1 Mr. Palmer aaid he had not heard the first Councilman say he hadn' t represented fairly; he said further he thought it only right to know where they stood on this. He said if City Attorney said Mr. Rigdon was not legally serving there was no reason for a public hearing. Question was asked of the City Attorney if the motion made two weeks earlier 160 liminated this appointment. Attorney said the motion could not affect special act. Mr. Van Buskirk commented to Mr. Rigdon that the new members were for asking clarification; that they were confused. He noted that certainly if Mr. Rigdon were not there from legal standpoint, the' they wanted somebo~ y there in legal stan- dpoint. He said no member of Council had said anything about anything that had been done. He said they only wanted to know if he were legally there. Mr. Schweizer asked if he was appointed more than 4 years ago and never re- appoin- ted, what was the status? Attorney said if appointed within the last 4 years he still had term to fill out. Mr. Hedrick said he had nothing to do with the resolution and he believed somebody was misinterpreting or reading into this thing something that wasn' t there. He said he questioned 4 people removing without cause according to wording of bill; whether or nota vacancy exists and whether or not extension had been made. Mr. Palmer then moved that the City Attorney between now and the next meeting determine by searching out records at . City Hall to resolve if he was reappointed and whether or not there was a vacancy and then if not an appointment could be made. Motion seconded by Mr. Schweizer. Mr. said he felt he was getting Rigdon railroaded to be real
