of money due to
the amount of clay that had been hauled in
there each year. He also asked if the City
could help out with the cost.
Mayor asked what the wishes of the Council
were.
Mr. Rigdon said it might be in order if the
Council went to the County Commissioners and
ask them to participate in the cost of the
paving.
Mr. Yoder said the people on the other side
would like to have relief since they had donated
all of the property for the street. Mr.
Shelley said they came before Council two
months earlier asking for help with water
and drainage out there and paving seemed to
be the only solution to the water. He

ALLEY NEAR : MC OONAtI)' s in alley north of McGriff Street in
the
HAMBURGERS Oakridge Addition ( vicinity of Mc Donald' s
Hamburgers) .
Manager announced that the amount of the
assessment for piping the ditch of 662. 35
feet was $ 1, 934. 06.
Mrs. Kate Bagley of McDonald' s Hamburgers
said she had been in business there for
ten years and that ditch was behind her
property and was offensive. She said
so
she had put up a but was ashamed

that she was ten years late in asking
that the ditch be closed and stated that
she was happy to pay her share of what-
ever it cost to close the ditch.
George Brenner of the Taco Hut Restaurant
said he too was in favor of closing the
ditch.
Mr. Brock moved that the assessment roll
in the amount of $ 1, 934. 06 be approved
for closing the ditch. Motion seconded by
Mr. Palmer and carried unanimously.
PUBLIC HEARING - Mayor then called for the hearing for
LINSTEW DRIVE Linstew Drive, Briarwood Circle, and
Neptune Court assessment roll.
Manager reported on a petition from the
residents of Neptune Court asking that
paving and drainage not be done on their

Brentwood Bryant said he lived on Neptune
Court and the petition had been un-
animously signed by all the property
owners abutting Neptune Court. He
said he did not care for the paving
and/ orthe drainage. He said ref: the
sanitary sewer - they were not against
nor particularly for it. He said they
were in' rea~6nably good shape with
septic tank at the present. He indicated
however with current pollution problems
they generally would be in favor of the
sanitary sewer if that would be appropri-
ate.
A gentleman from Linstew Drive asked if
Council were going to hear comments on
Linstew at that time.
Mayor commented that he didn' t see how
were going to break it up into two
hearings.
Manager commented on the drainage with
relation to Neptune Court; running
drainage back to the east on Linstew
and taken out at the point where Linstew
intersects Beal Street.
Mr. Hedrick asked if an engineering
study had been made of this area.
Manager replied that it had and that it
was done with engineering thinking
everybody wanted the paving and drainage;
was designed to go out through easement
on Neptune Court. He said the study was
made by the City' s engineering department,
and checked by Oliver Semmes, the
Consulting Engineer for the City.
Mr. Bryant said the drainage was
desig
ed to come down Neptune Court through
an easement which divided two lots
that he owned. He said the lot line
and easement between those two lots
took a dog- leg right front of his home
immediately in front of his front door.
He said the drainage was a prime concern
to him. He said it appeared it could run
down Linstew Drive and if could, follow
the right- of- way he felt this would be a
better way of engineering it.

Manager said possibility
one other would
be to pave without curb and gutter or
underground drainage and allow the water
to run as presently runs.

Linstew said soil was such that water
stands after a storm.
Mrs. C. R. Williams of Briarwood Circle
represented 8 property owners on
Briarwood; said they did not live on
Linstew and were not in favor of paving
the road. She said they didn' t part-
icularly want to pay to have Linstew
paved. She mentioned the nice beach area.
Mr. Van Buskirk asked if there were an
alternate plan or variations that could
be studied and looked over - particularly
for Neptune Court.
Mayor suggested possibility of someone
to represent the property owners to meet
with a small committee of Council to see
if they could come up with something the
people would want.
Mr. of Linstew Drive mentioned

dust
He said the resident of Briarwood used
the road and created as much dust as those
living on it. He said he didn' t want the
paving but felt they would need the
sewer.
Mayor commented that this was an unusual
project. He said he felt it would take
quite a bit of study.
Mr. of Briarwood said the only
Coker
thing between him and the water was an
easement of 20 feet. He said the City
1 1/ 2 years ago put in sod and stated
1
further that he didn' t know who on
Briarwood was using the street. He said
there was no place behind his house to
raise any dust.
Mr. Williams said they were going to pave
to his driveway and he said he was being
assessed the full distance of his property

MOTTON Mr. Van Buskirk

now than to begin with and since

this was his first meeting, he moved
since he felt a clear decision
could not be made now - that a com-
mittee of council meet with committee
of the people to sit down and work

to Motion
seconded by Mr. Rigdon.
Mayor asked the residents if they felt
they could come up with representatives
to try and work out something.
Mr. Shelley said that had a meeting
one previous week and at that time they
could come up with a workable solution.
He and several present confirmed that
they had a majority of the property
owners at their meeting. He indicated
however that he had not seen the con-
struction drawings at that time.
Mayor suggested that the committee meet
with the engineer using drawings and
possibly they could work something out.
Mr. Shelley said the subdivision was
formed in 1952 and indicated that wait-
ing till now to put in the improvements
and run cost up for everybody. He said
he would like to see it paved with sewer
and curb and drainage that this was the
only way of solving the whole thing.
Mayor commented that he Council
felt
didn' t want to
