solution does give her a little
more than she is currently drawing so if you so desire Mr. Chesser and I can word
jt where she would continue to draw what she is drawing but draw no more. This
particular part did allow for cost of living. Mayor , I presume (to City Attorney)
that you and Mr. Evans will get together - City Attorney - what Charlie is talking
about is, the provision maybe you know, the provision affecting in section 1 of
the resolution whic h says that 3% col is included in that 11.56 authorization. I
questioned that when I saw it when I saw the recommendation of Bill Lindsey, why
it in fact if were trying to cure a mistake why would you also cure a mistake by
putting a cost of living increase in. Whether you do that or not is something you all may
>
consider - I can put it in there and it is easier to take it out when you read as
an ordinance form than it is to put it in. So that is the way I will draft it.
I will draft it exactly the way you have it authorized here in case you want
to take it out you may do so.
Pat Thornber, can you let us know how much our responsibility and how much is Travelers
or exactly what we are obligated to. City Manager - if Travelers was involved to
the point of issuing a particular. insurance coverage
on this retirement and doing so without authority or without meeting the criteria
of the pension plan, do not we have legal recourse against Travelers" City Attorney-
yes. Grant - Is Travelers disputed for this claim? City Attorney - I don't
if they are disputing the validity of the claim, I think what they have said
I think they have admitted that a mistake was made and that quite possibly
it was their mistake. It was obviously theirs or ours and I don't care where
the mistake is but in any event a determination was made that this lady was
covered and when you get the plan out and go through the plan it is obvious
that you were not.
Mr. Grant apologized for taking up so much time but, maybe it is me, but somebody
maybe it is me but somebody I feel hasn't done their homework on this thing,
and we are trying to paint it over or something or other, we really are not addressing
what the problem is, I would like for somebody to explain to me what is the
problem. City Clerk - Mr. Grant We have about a 3 or 4 page report from Mr. Lindsey
that gave the whole history of it at the last meeting - in fact the last 2 meetings.
In fact went back from day one all the way through. Mr. Grant - ok let's take it
right there, When after he got through all that - those pages, rather than mak ing
a recommendation he gave us a bunch of options, right. City Clerk - he gave you
4 choices. Grant - In other words he did not make any recommendationsat all.
I think that is when my heartburn starts, right.there. Why can't he give us
a recommendation? Mrs. Thornber, he did after he gave the 4 option he said
I recommend option 2... Franklin - he is an advisor. He advises us and we can
go this way or this way or this way. You Know when you make a recommendation you
say, this is the best - go with it, in this particular case, he just gaveus
four options and said choose either one of them; we chose one and that is the
way we are right now. Mayor - we have voted and Mr. Chesser will come back
with an ord. City Attorney - with an ordinance that does the same thing
this resolution does and in the meantime we will make another payment to the lady
so that that the status quo is preserved until we can try to resolve it.
Thornber - also please spell out exactly what the City's obligation is. City
Attorney - If I can find out then I will do that; I am not really sure that I can
Mayor - Now does your motion mean that we do pass this tonight? City Attorney,
a =. 9 Q

No, I don't think so, J think your motion isto simply authorize the payment of
that money for one more month until we can resolve the situation.
Mayor - ok fine, then we understand it.
