VARIANCE FOR A 6' City Manager stated that the
last meeting, Council
at
SIDE YARD SETBACK granted a variance for a foot side yard setback
six
191 Miracle Strip to Joe Bruner. His surveyor gave him his building
Pkwy. line on a ' three- foot mark rather than a six- foot
mark. He is now requesting a variance for a three
foot setback.
Dr. Houghton moved to grant a three foot variance.
Motion was seconded by Mr. Rigdon.
City Attorney said, this should go through the
Hearing Boards. It is a variance and it should be
advertised to meet the criteria of the law.
City Manager explained that this was granted by
Council prior to the time you instructed us to
send all variances through the boards.
Mr. Grant moved that the original motion be wi th-
drawn and that the variance request go through the
boards.
Dr. Houghton said Council granted it in the first
place. The adjacent property owner has no objection
to the variance, but I have no objection to him
going through the channels.
City Attorney stated that he does not have to stop
with his building provided that he does so on the
basis that he assumes the risk of the Hearing Panel,
Planning Board and Council' s ultimate decision. It
will meet the requirements of the law if you send
it through that procedure.
Mr. Baughman said,
that building would be sitting
three feet from the shopping center and if it
catches fire and also burns down the shopping center
and we haven' t granted that variance legally, the
1
responsibility falls back on us.
Dr. Houghton withdrew his motion to approve the
variance.
Mr. moved that the variance go through
Grant the
proper channels. Motion was seconded by Mr.
Baughman and carried unanimously.
REQUEST FOR SET- Public Works Director stated that the City is con-
BACK FOR RADIO structing a radio tower at the Civil Defense Building.
TOWER
o80 3/ 11/ 80 & 3/ 18/ 80
The height of the tower would require a 160 foot
setback. The property is not big enough for that
so we are requesting a 72 foot setback.
Mr. Grant asked if the wind requirements could still
be met with that setback. Public Works Director
replied, yes.

FROM CITIZENS letter from the Citizens Beautification Comrrdttee
BEAUTIFICATION stating that it will take months to come up with a
COMMITTEE sign ordinance. However, the City of Shalimar has
contacted the Beautification Comrrdttee and asked
to work in coordination with the idea that whatever
we adopt they will adopt within the same time frame.
