Fort Walton Beach Ordinance — 214 - Permited Construction Must Conform to Surrounding City — reading text

ORDINANCE NO, 21) AN ORDINANCE ENTITLED AN ORDINANCE PROVIDING THAT NO PERMIT FOR THE CONSTRUCTION OF A DWELLING IN THE CITY OF FORT WALTON BEACH, FLORIDA, SHALL BE APPROVED BY THE BUILDING INSPECTOR UNLESS SUCH PROPOSED BUILDING SHALL, IN THE JUDGMENT OF THE SATD BULLDING INSPECTOR, CONFORM AS TO SIZE, MATERIALS USED, AND COST TO BUILDINGS IN THE IMMEDIATE SURROUND- ING AREAs AND DECLARING AN EMERGENCY. WHEREAS, The City of Fort Walton Beach has not heretofore set up standards for the various building permits to be issued by the City of Fort Walton Beach, Florida, in order to conform with the surrounding area, and WHEREAS, substandard homes have been built from time to time in areas designated as strictly single family residential areas, and WHEREAS, the construction of such type buildings has resulted in the decreased evaluation of property costing many times more than a normal sale would bring because of such construction of substandard housing, and WHEREAS, it is desired that a uniform code be set up for the various residential areas, and WHEREAS, it is urgently necessary that a stop-gap measure be taken to protect the property rights of the individuals of the City of Fort Walton Beach, Florida, and WHEREAS, it is urgently necessary that such steps be taken immeciately NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WALTON BEACH, FLORIDA, AS FOLLOWS: SECTION I, That hereafter no city building permit for the construction of a dwelling in the city shall be approved by the City Building Inspector unless in his judgment such proposed buildings shall conform as to size, materials used, and cost to buildings in the surrounding area. SECTION If. That if any section, paragraph, clause or provisions shall be heid to be invalid or unenforceable for any reason, the invalidity or the unenforceability of such section, paragraph, clause or provision shall not affect any of the remaining provisions of this ordinance. SECTION III, That by reason of the urgent necessity for immeciate legislation to control the construction of dwellings in the City of Fort Walton Beach there is an urgent public need for the preservation of the public peace, health, safety and property requiring this ordinance to take immediate effect, and it is therefore provided that this ordinance shall be in full force and effect immediately upon its adoption.
