262 CP02- 1 as an amendment to Ordinance 1401, as previously amended,
263 to wit:
264
265 Section 2 of the Mixed Use subsection of the Future Land Use Element
266 of Ordinance 1401, entitled Mixed Use Main Street ( MAP LEGEND
267 MUMS") is amended as follows:
268
269 2. Mixed Use Main Street ( MAP LEGEND " MUMS"). This mixed use
270 area designation is one that supports the mixed use concept in an area
271 where the commercial component is based on entertainment/tourism.
272 The mix of uses will allow for some residential use to provide incentive
273 for home businesses and residential projects, which will provide a
274 housing mix to accommodate the local population. The emphasis here
275 is for land uses to contribute to the Main Street area becoming a
276 happening place", a place for special events, shows, performing arts,
277 theatres, fine dining, exclusive shops, professional offices. Maximum
278 height of all structures shall be 50 feet. Residential density shall be
279 limited to 12 dwelling units per gross acre. Provision will be made via

281 maximum of 15 units per acre. These bonuses may be obtained by
z82 including specified design features listed in the CRA Plan Update that
83 support the intended uses, urban characteristics and pedestrian
284 orientation of the area. Lot coverage is unlimited because structures
285 will be encouraged to be placed near the public ways and because off-
286 street parking will not be required on- site. A maximum Floor Area Ratio
287 of 4. 0 is permitted.
288
289 The CRA's Urban Master Plan will provide this area a physical plan for
290 transforming the former downtown area into a pedestrian friendly area
291 that re-routes the through traffic volumes onto the four- Ianed U. S. 98 to
292 First Street one block north, which will provide room for wider
293 sidewalks, traffic- calming devices, crosswalks, streetscaping and on-
294 street parking.
295

302

304
305 Should any section or provision of this ordinance, or any portion thereof, be
306 declared by a court of competent jurisdiction to be invalid, such decision shall not
307 affect the validity of the remainder, as a whole or any part hereof, other than that
