tMENTS ( CONT.) H. T. Smith, Chairman of the Municipal Planning Board,
reported that the Board believes the scope and intent
of the required sections of 9J- 5 are not adequately
represented in the draft element. He again recounted
the difficulty the Board has had in receiving
cooperation from the contractor. He then reported
that the Board recommends the Recreation and Open
Space element not be accepted as prepared by Barrett
Daffin & Carlan until the documents meet the criteria
of Rule 9J- 5 and payment be withheld until an
acceptable document is obtained from BDC.
PUBLIC INPUT The Mayor asked if there was anyone from the general
public who wished to address this element. There
being no comments from proponents or opponents. the
Mayor closed public input and opened the floor for
City Council discussion and debate.
COUNCIL DISCUSSION Discussion centered on the Municipal Planning Board' s
recommendation that this element not be accepted and
payment be withheld. Mr. Wyatt questioned whether
Council had the freedom to take such action. The City
Attorney answered that the City has a contractual
obligation with
County underthe
the interlocal
agreement wherein the
County has a responsibility and
the City is bound to compliance requirements under
that contract. The Mayor wished to know if there were
any legal means for the City to withdraw money. The
City Attorney stated that the City is bound by the
interrelationship.
Mr. Rosenbaum moved that the Recreation and Open Space
draft element be submitted to the Okaloosa County
Board of County Commissioners with a submission letter
stating that the City retains the right to make final
decisions before final submission. Motion was
seconded by Mr. deVaux.
Discussion followed on the point that the element does
not meet the criteria of 9J- 5. The City Attorney
commented that the elements
preliminary are in the
stage. Mr. Mikel noted that it is important that the
draft elements be submitted to DCA by the deadline
date in order to receive DCA' s comments on problem
areas .
The Mayor called for the vote on the motion, and it
carried by a vote of 5 to 1, with Rosenbaum, Wyatt,
Bobo, Tona and Roberts in favor, and deVaux opposed.
