299 MINUTES OF SPECIAL MEETING OF CITY COUNCIL OF FORT WALTON BEACH, FLORIDA August 31, 1976 I INTRODUCTION A special meeting of the City Council of Fort Walton Beach, Florida was held at City Hall on Tuesday, August 31, 1976 at 3: 30 p. m. with the following members present: COUNCILMEN George A. Palmer Robert L. Hunt Charles H. Hill John H. Bishop Hurdis A. Brock James K. Baughman Mayor Smith ALSO PRESENT: City Manager, City Attorney, City Clerk- Finance Director ABSENT: C. H. Rigdon, Jr. WAIVER OF NOTICE OF MEETING Mayor read Waiver of Notice of Meeting. Mr, Hunt stated that in order to clarify the Waiver, he moved that the discussion be restricted to the sale of the Scott Steel property. Motion was seconded by Mr. Palmer and carried unanimously. REQUEST FROM H. H. CARNATHAN Mr. H.Carnathan was present at the H. meeting and asked that Council hear his request for a variance to build apart- ments in a C- l zone. Mr. Hunt moved that Council hear Mr. Carnathan' s request at the conclusion of the original purpose of the meeting. Motion was seconded by Mr. Baughman and I carried unanimously. LARRY SCOTT REQUEST Mr. Hunt stated that he had a conversa- tion with Larry Scott yesterday. I was not aware until just before the time that the option had expired on the property. I would like to make a motion at this time that the sale of the property as discussed at the previous Council meeting be denied. Motion was seconded by Mr. Palmer and Mayor called for discussion. I: .~ j o, s/ a) 7' 900 Mr. Palmer stated that he feels that if we start this we will have to do the doing same for everyone. We have had complaints from outside people. We will have com- plaints if we don' t rescind this action. Mr. Baughman stated that Council needs to approach the Industrial Park in a little different way. We need to actively promote the Industrial Park. The Council has agreed with this approach in the past, but if we go ahead with Mr. Scott' s request, we might be setting a precedent. This is why I am going to favor this motion. Motion carried unanimously. CARNATHAN REQUEST Mr. Carnathan stated that he has started building two tri. plexes on Wdght Parkway. According to the code, multi- family dwellings in a commercial zone must comply with the requirements of commercial zoning as far as the type of material is concerned. These two are constructed of buildings brick veneer and reverse board and batting. I would like for Council to grant a variance so that we can go ahead with what we have here and I will come back at the proper time to ask for re- zoning to residential. I have had the first inspection from FHA, then we called for our permit from the City and Mr. Hudson put a stop to our work. Mr. Hunt stated that what you are talking about is requesting a rezoning from commercial to R- 2. City Attorney stated that the structure he is building is all right for R- 2 but all masonry is required for C- 2. The quickest thing to do would be for Council to grant a variance as long as the build- ings are used for multiple housing units I] only and not for commercial use. Mr. Bishop stated that Ace Hardware came for a similar variance and they had to have a 10- foot setback. Mr. Carnathan replied that their setback would conform to R- 2 zoning. Mr. Carnathan explained that there is one lot which he owns that is between gftl/ 7' what he is building here and a greenhousa I He owns the property on the other side. Mr. Palmer moved to grant a variance to allow the construction of multi- family dwellings on Lots 10, 9, 8 and 7, Block 3 Oakland Subdivision ( 40, 42, 44 and 46 I Wright Parkway) in a C- 2 zone provided the R- 2 are only and buildings meet the requirements of zoning regulations. These buildings to be used for multiple housing units not for commercial use. Motion was seconded by Mr. Hill and carried unanimously.
