I stations. I am interested in setting up a not 1 speed trap, but I interested in the safety I am and welfare of the people who work downtown I and visit there. Dr. Houghton asked if we could put up a traffic light in front of the Sheraton. The section from the Sheraton to the Brooks Bridge is our most crucial area. Chief Ray said that this has been discussed with DOT, and they are the ones who pulled 3/ 14/ 79 1 77 down the light at the Sheraton. After proper notice is given, then enforcement of the law is proper and I will so fu11fi11 the wishes of this Council. If the City Manager instructs me not to give five miles over the speed limit grace, then there will not be five miles over I the speed limit grace given. We will issue tickets. However, I would like to see proper notice coordinated through the DOT, signs across Highway 98 giving the speed limit, flashing lights, or congested area signs. Until we do that we are not going to relieve the pro- blem. Mr. Hunt said, I agree with what you are saying, but by the time we communicate back and forth with DOT, it will be a while. Can It we issue some warning tickets for a week to ten days? Mr. Rigdon asked what the City would have to do to get the speed limit changed to 25 mph from Joe Guidryls to Brooks Bridge? Would we have to get permission from the State? I think it should be 35 mph from the Sheraton to Guidry' s and 25 mph from Guidryls to the Bridge and I think it ought to be strictly enforced. We should put a notice out. Mr. Hunt moved that between the Sheraton and Brooks Bridge the speed limit be established at 25 mph. Motion was seconded by Mr. Rigdon. Dr. Houghton asked to amend the motion to start at Liollios with a 35 mph limit to the Sheraton. Mr. Hunt said we don' t need to jump from a 55 mph speed limit to a 25 mph limit within a mile. I think we need some time to study it. The congested area is what I am trying to take care of right now. Mayor said perhaps warning tickets could be issued. Stop the man as of tomorrow and donlt I let anybody go any faster than 25 mph there. Chief Ray recommended that you back up to the City limits and set the speed limit at 35 mph going east. Then in the congested area, start the enforcement. They have had adequate time when they break into the City limits to slow down. Then start enforcement in the congested area along Guidryls, Liollios and in that area. C- 3/ 14/ 79 1.78 Mr. Hunt changed his motion to read changing the speed limit to 35 mph from the western City limits boundary to Brooks Bridge. Motion was seconded. Mr. Bishop said we have been talking about flashing signs across the road. If we wait on the State, we may get them next year. Could the City make some signs to go on the side of the road, or would we still have to go to the State? City Manager said, heretofore we have coordi- natedany changes in speed limit with the State. I don It think they will object, but I think we still should coordinate through them. In answer to Mr. Bishop' question, yes,sI think we can ask for their acceptance of City- placed signs. We have already written to them on these flashing signs. Question was called for and motion carried unanimously. UTILITIES FOR CONVEN- In reference to the utilities for a Convenience IENCE STORE ON MOONEY Store on Mooney Road, City Manager said Council ROAD had asked him to find out where the utilities came from to serve this store. Water service to that store is a connection into a water line running to Apartment # 7 in the apartment com- plex next door. The City did not know of its existence, and there has been no bill mailed or paid on that store to our knowledge since its existence. Mr. Hunt said, theI had was, questionin the original agreement when the City furnished water to the apartments, there was an agreement made that the property would be annexed into the City at the end of some period of time. Did that legal description include the location of the convenience store? City Manager replied, the convenience store.. l.. is included in the annexation ordinance . not legal, or in the agreement. It is not in the City limits-- it is on City water. Mr. Hunt asked what the City ordinance says on furnishing City water outside the City limits. City Manager replied that the ordinance states that we will not do this. I assume that in this instance what we would do is issue him notice and he can be given the choice of 3/ 14/ 79 1 79 annexing the store or providing his own water service at the end of a reasonable length of time. Mr. mentioned a Texaco station on the Rigdon Mary Esther Cutoff who had City water and we tried to get him to annex or not provide. him I service. We were advised that if there was water out there, we better City Attorney said, just leave it alone. the difference in this situation is that the City originally furnished the utilities as a condition to them agreeing to annex to the City at a certain point. City Manager explained, this particular piece of property was not discussed. It is being served from an area that was annexed. This was not a service run by the City. It is a service unknown by the City until now. City Attorney said, if the City did not sanction the service, I donlt think there is any problem in terminating the service upon reasonable notice. Mr. Hunt said, in view of the circumstances that exist the present time, it would be at appropriate for us to give an adequate notice to annex that property into the City or to inform him he will have to make other arrange- ments for water. He so moved. Motion was seconded by Mr. Bishop and carried unanimously.
