Dear Elliot,
T am writing this letter in my capacity as legal counsel for Kelly Plantation Owner's
Association, Inc, with the intention of expressing-my client’s qualified approval of the
modification of the Kelly Plantation Master Plan PUD Development Oider as shown on the
Master Plan Map as amended and submitted by Synovus Bank (“Bank”), This letter follows
meetings by the HOA Board of Directors with the representatives of the Bank, my .eview of
the modifications to be subinitted.to the County by the Bank as applicant. for the
modification and formal approval of the modification by the Board. at its December, 2012
Board Meeting,
Please consider this a written approval of the removal of the two parcels owned by the
Bank from the boundaries of the PUD Master Plan and the reallocation of comumerclal
developinent rights as:‘shown on the modified charts on the face of the Master Plan Map,
The Board has authorized me to represent its approval on the condition, already accepted by
the Bank, that these parcels zemain subject to the Kelly Plantation Coramercial Declaration
of Covenants, Conditions and Restrictions and the jurisdiction of the Kelly Plantation
Commereial Ownets Association, Inc, after zemoval from the PUD boundary.
