COUNCIL VACANCY ( CONT.) The City Manager reported he was unable to contact
Councilman Maney. his phone has been busy the whole
time; he spoke to Councilman Rosenbaum' s wife, and he is
not home yet; and Councilman deVaux, the same situation.
The City Attorney suggested Council adjourn again until
a certain time and send someone physically to the
residence of the three absent Councilmen. He said he
thinks Council needs to make a best effort to
communicate to them that that Council is in session.
Ryan Fisher said. to the best of his knowledge, the
three Councilmen were not at their residence; and he was
interjecting this to save the trouble of going to their
house. He said he did not know where they were going to
spend the night, but he did not expect City staff to
stay here all night waiting on them.
Mr. Smith stated. either for the record or off the
record. this is like
you punish. a child
they don' t if
get their way, they go on and on and on, you give in to
them and that is exactly what they want you to do. He
said he is willing to stay or whatever it takes.
The Mayor said he did not think the City needs to be
embarrassed any further tonight by sending a police
officer after them; and he thinks it has been
appropriately done already this evening. He said. in
his opinion, he thinks they should be compelled to be
here. but not by police force as a means to do it; it is
obvious they do not want to be here.
Mr. Smith moved to adjourn the meeting until 5: 30 p. m.
tomorrow. July 25. 1990. Motion was seconded by Mrs.
Wyninegar.
John Smith wished to know if the absent Councilmen can
be subpoened to attend the next meeting.
The City Attorney stated Council did not have a quorum
to any actions other
take than to try to compel their
attendance and to adjourn.
Alice Wyatt commented the City Council should wait it
out because she did not think these men should be
allowed to hold the business of this City hostage like
this.
Ed Langdon agreed with Mrs. Wyatt' s comment, further
stating they have a responsibility and they should be
held accountable.
Mr. Smith withdrew the motion.

Ned Langdon wished to know if there was a duty owed to
the citizens. The City Attorney stated he has made it
clear what he thinks is the responsibility for
attendance of a Council member. Mr. Langdon then wished
to know if the citizens will be notified. The City
Attorney said Council is in session and it would be a
continuation of a session, there is no technical problem
with that.
There followed discussion on whether to continue with
the efforts to return the absent Council members to the
meeting this evening or whether to adjourn until
tomorrow.
Mr. Wyatt withdrew the motion.
