RES 0 L UTI 0 N NO. 79- 32 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FORT NALTON BEACH, FLORIDA FINDING AND DECLARING A NEED FOR A HEALTH FACILITIES RENTAL PROJECT FOR THE CITY OF FORT WALTON BEACH, FLORIDA; AUTHORIZING THE CITY ATTORNEY AND THE CITY MANAGER TO PERFORM CERTAIN ACTS RELATING TO SUCH PROJECTiAND SETTING FORTH ADDITIONAL TER~ S AND CONDITIONS FOR THE COMPLETION OF SUCH PROJECT. WHEREAS, the City Council of the City of Fort Walton Beach, Florida perceives that a need exists in the Fort Walton Beach area for living facilities for the elderly with reasonable access to adequate medical care and health facilities, and WHEREAS, the City Council of the City of Fort Walton Beach, Florida believes that the general concept of housing Inc. for the elderly submitted by Westwood Retirement Homes, is a desirable project for the Fort Walton Beach Area. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WALTON BEACH, FLORIDA, IN SESSION DULY AND REGULARLY ASSEMBLED, AS FOLLOWS: of the City of Fort Walton Section 1. The City Council Beach, Florida directs its attorney to prepare a resolution for to the Council at the earliest possible date presentation health facilities authority to function within the creating a of Fort Walton Beach, Florida with the Council municipality reserving the right to name the initial members of the authority at the time of the presentation of the resolution. Section 2. The City Council of the City of Fort Walton Beach, Florida instructs its City Manager or other appropriate to initiate the annexation process authorizing the persons annexation of that property described in Exhibit A. Section 3. That in the event the annexation referred to in is completed the property be rezoned the preceding paragraph R2 with a specific stipulation that a health care facility for the elderly be allowed to be constructed on said property and that full consideration will be gIven to allowing the varIances necessary to construct the project as presented to the Council. Section 4. That the Council agrees to extend existing water and sewer lines to the project site provided the the appropriate amount developers of project agree to pay an for the extension of such lines. Section 5. That this resolution IS conditional on an opinion from the City Attorney affirming that neither the the proposed authority can in any proposed project nor create liability for the City of Fort Walton Beach, way any its assets or its revenue and that this resolution is further contingent on the construction of the project by a nonprofit corporation with the sole purpose of providing additional health related living units for the elderly. Section 6. That this resolution being of an administrative nature shall take full force and effect immediately upon its passage and approval by the Mayor.
