SIGN ORD. ( CONT' D) Mr. deVaux said he would like to see the fee be fifty
times the cost of the permit or $ 250. 00. The City
Attorney interjected that he feels it is legally
border:ing unreasonable and possibly a denial of due
process to incur a fee fifty times the cost of the
1
permit.
After comments from staff. it was suggested to illpose
a $ 50. 00 fee after the fact.
Mr. Tona asked if it would be advantageous to add
verbiage to penalize the sign owner or owner of the
business who violates the ordinance. The City
Attorney responded that he is satisfied with how the
ordinance is written.
The continued
Mayor to 1418. 03. Application Form.
which deleted. and went on to
was
Exempted Signs and
Activities. which is now 1418. 03.
Mr. questioned the deletion of " temporary in
deVaux
nature" with
regard to real estate signs. There
continued some deliberation on this point. and Mr.
Bobo said he would have no problem to leave it in
there. Mr. Tona said he would like to add. nthe
n
immediate real estate... The City Attorney said the
Off- Premise section covers that; therefore. Mr. Tona
said he was satisfied.
The Mayor went on to section h. chang:ing fifteen to
ntwenty. feet for political signs not being placed
within that many feet of the street curb. The Sign
Inspector explained the difference. and the Mayor
continued to section r. subsection 3 and 4. The City
Manager said the change is a suggestion from staff.
with the Sign Inspector adding that when a new owner
of a gas station starts a business. he would have the
same advantage as the established gas station owner.
The Mayor addressed section t. changing twenty percent
to nfifty. percent for signs : in the window. Mr. Bobo
said this was prompted by the seafood wholesaler who
needed more window space for advertising. The City
1
Manager expressed his personal opinion in that fifty
percent is too1arge.
Mr. Jen:y Miller. 11 Driftwood Drive. said when he
helped initiate this ordinance as a previous
councilman. the intent was to relieve the. grocery
stores who run specials.

The Mayor suggested if councilmen have a recommended
change to approach staff with their suggestion,
whereby Mr. Tona said he would like to have the
Council as a group discuss the changes to receive
input from each other.
Mr. Wyatt feels the Sign Ordinance is very complex and
deserves a lot of' discussion; and would like to
suggest to adjourn the meeting after the completion of
the next page, set up another meeting, and commence
from that point where Council left off.
Mr. Bobo reminded Council that section t has been in
the ordinance since its
inception other than the

leave it as is and continue to more significant
