© Oo Resolution 05-32 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FORT WALTON BEACH, FLORIDA; RELATING TO A PUBLIC IMPROVEMENT BY SPECIAL ASSESSMENT; DECLARING IMPROVEMENTS OF WATER, SANITARY SEWER, STREET AND DRAINAGE ON STOKES AVENUE, IN THE CITY OF FORT WALTON BEACH; SETTING A TIME AND PLACE FOR A PUBLIC HEARING BEFORE CITY COUNCIL; SETTING AN ESTIMATED TOTAL COST OF THE IMPROVEMENTS _IN ACCORDANCE WITH APPROVED PLANS AND SPECIFICATIONS; LEVYING ASSESSMENTS FOR THE TOTAL COST OF SAID IMPROVEMENTS; ESTABLISHING THE MANNER OF ASSESSMENT AND METHOD OF PAYMENT; IDENTIFYING THE LANDS TO BE ASSESSED; PROVIDING FOR PUBLICATION OF THE RESOLUTION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of Fort Walton Beach, Florida, declared a special assessment for water, sanitary sewer, street and drainage improvements on Stokes Avenue at the Council Meeting held August 23, 2005; and WHEREAS, the City provides continuous maintenance of the existing clay/gravel/asphalt roadway of Stokes Avenue; and WHEREAS, these improvements are required for further development on Stokes Avenue; and WHEREAS, the majority of the property owners along Stokes Avenue are in favor of an assessment district for these improvements. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WALTON BEACH, FLORIDA: SECTION I: That the City of Fort Walton Beach shall make water, sanitary sewer, street and drainage improvements on Stokes Avenue in the City of Fort Walton Beach in accordance with plans and specifications on file at the City Clerk’s office, and as may be amended during the progress of the work. SECTION II: That the City of Fort Walton Beach shall hold a Public Hearing in the Council Chambers at City Hall, 107 Miracle Strip Parkway SW at 7:00 pm or as soon thereafter as the issue may be heard, Tuesday, October 25, 2005, at which the owners of the property to be assessed or any other persons interested therein may appear before said City Council and be heard as to the propriety and advisability of making such improvements on Stokes Avenue. SECTION III: That all lots and land specially benefited by these improvements on Stokes Avenue have a special assessment levied against them. The approximate estimated total cost of said project is $228,018.08, and that cost will include construction costs, engineering costs, permit fees, O O and other costs associated with processing this assessment. The description of the property and amount to be assessed, in the form of a Preliminary Assessment Roll (Exhibit “A”), is hereinafter provided for. SECTION IV: That the water and sanitary sewer assessments shall be levied on a per square foot basis and the street and drainage assessments shall be levied on a per front foot basis. All assessments are due and payable thirty (30) days after completion date of the improvements and a resolution accepting the same is adopted by City Council. Thirty days after completion of the improvements and after adoption of the resolution accepting such improvements, interest will accrue at the rate of five percent (5%) per annum on the unpaid balance. The assessment may be paid in twenty (20) annual installments. SECTION V: That lands upon which said special assessments shall be levied are described as: All lots and land adjoining and contiguous or bounding and abutting upon such improvements or specially benefited thereby and further designated by the assessment plat (Exhibit “B”) hereinafter provided for, said property being located at 200 through 220 Stokes Avenue, NW, and 753 through 755, odd, Lovejoy Road, NW, in the City of Fort Walton Beach, Florida. SECTION VI: That the City of Fort Walton Beach shall cause this resolution to be published two times, a week apart, in a newspaper of general circulation and the last publication shall be at least one week prior to the dated of the Public Hearing. Thirty days notice in writing shall also be given to each property owner by certified mail as to the amount thereof to be assessed against each property so improved. SECTION VII: That this resolution shall take effect upon approval by City Council and signature by the Mayor.
