BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: August 5, 2014 TO: Honorable Chairman and Members of the Board FROM: Elliot Kampert SUBJECT: Letter to Department of Economic Opportunity Regarding PGI - CDBG 94DB-1A-01-56-01-E38 DEPARTMENT: Growth Management BCC DISTRICT: All STATEMENT OF ISSUE: Authorize Chairman to sign letter to Department of Econom,ic Development agreeing to enter into letter of agreement for use of program income funds from CDBG 94DB-1A-01-56-01-E38. BACKGROUND: During its regular meeting of November 17, 2009 the Board of County Commissioners approved the use of program income from a 1994 Community Development Block Grant (CDBG 94DB-1A-01-56-01-E38) in an amount not to exceed $312,160 to pay for a portion of the costs associated with the Blackman Community Water System upgrade. Polyengineering acted as agent for the Blackman Community Water System and managed the upgrade. No County funds were used in the project, and Polyengineering ultimately used only approximately one-third (•) of the amount authorized by the Board and then-Department of Community Affairs, now Department of Economic Opportunity (DEO). In July of 2013, the DEO reviewed the use of the program income, and found that neither Polyengineering nor its subcontractor, Morgan Contracting, had kept a certified payroll as required by the rules governing the use of CDBG program income funds. In a letter dated February 4, 2014, the DEO requested that the County send a letter agreeing to enter into a Letter of Agreement prior to the expenditure of any further program income associated with the subgrant. OPTIONS: The Board may authorize the Chairman to sign the letter, or not. RECOMMENDATIONS: Growth Management staff recommends that the Board authorize the Chairman to sign the attached letter to the Department of Economic Opportunity agreeing to enter into a Letter of Agreement prior to any further expenditures of program income from CDBG 94DB-1A-01-56-01-E38. RECOMMENDED BY: APPROVED BY: Ernie Padgett, County Administrator
