Recommends City Council adoption of Ordinance No. 1916 to amend Section 8. 08 of the Code of Ordinances to revise the hours and requirements of door-to-door solicitation within the City limits. The City Attorney read Ord. 1916 on first reading. He advised this ordinance was brought to Council last month and was postponed due to a letter the City received from a law firm in Tallahassee whose client wants to do business in the City. Their main concern was in reference to the times of solicitation in the ordinance, which was stated between 10 am and 4 pm on weekdays. The City Manager advised the amended ordinance changes the soliciting time from 9 am to 7 pm on weekdays. City Council of Fort Walton Beach Page 7 Printed 5/ 6/ 2015 Regular Meeting Minutes April 28, 2015 Atty. E. Dylan Rivers of Ausley & McMullen in Tallahassee explained his client does a lot of business in the state and noted their two major concerns are that the proposed ordinance treats commercial solicitation differently and more restrictively than other types of solicitation, and noted the limitation on commercial solicitation on the hours is overly restrictive. Council discussion included changing the end time from 7 pm to sunset to coincide with the summer and winter months. The vote on the motion to adopt Ord. 1916 on first reading, as amended, to reflect the hours for soliciting between 9 am to sunset on weekdays only, carried by a vote of 5 to 2.
