BOD & LIBRARY REPORTS Mayor presented BOD Report and Library Report for council information only. PURCHASE ORDER FOR FIRE Mayor presented a letter from City Attorney TRUCK: SUTPHEN FIRE regarding purchase order for fire truck EQUIPMENT COMPANY Sutphen Fire Equipment Co.). " I looked at the purchase order from the City of Fort Walton Beach pertaining to the purchase of the fire truck from the above fire equipment company, and noted at the bottom of the purchase order that you have any change in price or material auto- matically voids this purchase order." This would appear to permit someone to change their price or materials and thereby void the contract. I think this should be deleted from the purchase order itself." Mayor stated that at the last council meeting council had inquired as to whether or not the company we ordered the fire truck from was in violation saying they were going to charge us more. City Manager stated that after talking with City Purchasing Agent, he found that this sentence was put on the purchase order years ago, to keep anyone from changing the purchase order or the price on the purchase order. At that time, it worked for the benefit of the city. With things as they are now, it is working as a disadvantage to the city. I Mr. Baughman moved that the sentence be deleted from the purchase order. was seconded by Mr. Rigdon. Motion Mr. Van Buskirk stated that what council is interested in is whether the city can make the equipment company hold to their bid price. City Manager asked that since they submitted a sealed bid guaranteeing a price and delivery date, does this not at. any r 1280 any obligation on their part to deliver. City Attorney replied that this would obligate them, however when you submit a purchase order with these terms on it, you leave them an outlet. t~ a;~~ u~~; l o " ha~~~~ ~~ ni~ J,.. h~:~ d~~ t~: r; truck or whether you want to re- advertise .. it. City Manager replied that with prices going up, an order placed as long ago as this one was and having to wait a year for delivery, I think we are better off letting the order stand.
