EFFECTIVE DATE HEREOF. Mr. Hill moved that the ordinance be approved on first reading. Motion was seconded by Mr. Rigdon. Mr. Grant stated that he endorses the idea of the 1 ordinance, however feels that the average homeowner has no protection against price gouging. Mr. he Hunt has disagreed with Mr. Grant and all the protection he needs. stated he feels Mr. Baughman asked, under federal and state laws, do we have the right to control prices? City Attorney replied, the ordinance could be con- tested in court, but this would give us some method by which to prevent gouging. Question was called for and motion carried unani- mously. Mr. Baughman stated that he believes any ordinance which comes this Council should not come in before an already prepared all Councilmen are not form when aware of it. All ordinances should be in draft form and should come from Council direction. Mr. Hunt disagreed with Mr. Baughman 711 RE : NUISANCE 711 AN ORDINANCE ANENDIlJG SECTION 10- 21 AND SECTION ABATEMENI' 10- 22 OF THE CODE OF OIDINANCES OF THE CITY OF FORT WALTON BEACH, FLORIDA, CO~1BINING BOTH SECTIONS 10- 21 AND 10- 22 IN A SIHGLE NUISANCE ABATEMENT ORDINANCE TO MAKE IT UNLAWFUL FOR ANY OWNER, CUSTODIAN, AGENT, LEASEE, TRUSTEE, OR OCCUPANT OF ANY LOT, PARCEL OR TRACT OF LAND, WITH OR ~ nTHOUTIMPROVEMENTS THEREON, TO CAUSE A NUISANCE, PROVIDING THE EFFECTIVE DATE HEREOF. E. and Mr. Fbwler has not responded. The memo requested Council guidance as to whether to continue to try and reach Mr. wler. R> City Attorney stated that this piece of property may back revert to the original owner within the next thirty days. ( Mr. Fowler has been leasing the property). He requested time to verify the owner- ship. Mr. Rigdon moved that the matter be tabled until City Attorney can obtain necessary information. Motion was seconded by Dr. Houghton and carried unanimously. BEAUl'IFICATION Dr. Houghton stated that at the last meeting Council a:: ITEE MEMBERS M[[' requested a list of the Beautification Committee. We have been supplied a partial list. It was reques- ted that the Committee be studied and that it be composed of an equal amount of business people and other people. He suggested that the Mayor go over the list. There are five people who were appointed by a previous mayor. However, there are other peo- ple on the committee whom the Mayor did not appoint. I feel that the Mayor should study the list. There is one name on the list who is not a resident of Fbrt Walton Beach. I would like to see the Mayor appoint an equal amount of business people to serve on the committee. Mr. said he feels that when we appoint a com- Hunt mittee, it should not be a standing committee that meets once a month. I think a committee assignment should be to look at a particular problem that is of interest to the citizens and when that study has been completed, the committee should be terminated. Mr. Baughman said he agreed with Mr. Hunt for most committees but feels Beautification Commit- that the tee should be continued. I do think it is wrong for us to lose sight of who is on the committee. We should have a set number of members and Council should appoint them. Mayor stated that he has appointed a Beautification Committee consisting of Council members, and the citizen' s Beautification Committee is to report to the Council committee. Dr. Houghton said he thought the Mayor or Council should appoint the committee and the committee itself should not appoint members. Mrs. Hale said that the Committee asked for approval T: 9/ 25/ 79 9"' J... ,.'... of all members with the exception of the last few. Mr. Hunt again said that he is not in favor of standing committees. Mr. said he feels there needs to be time Rigdon limits for committees and that he is not in set 1 APProvAL FOR TYING IN D~ S favor Mr. of people serving who do not live inside the City limits. Bishop said that at the last meeting, Council approved a recommendation from Public Works Director reference tying in driveways. As I understand it, Rex did not make a recommendation. I don' t think the City should go around tying in driveways when we have contractors who can do that. Mr. Rigdon said he made the motion to give Public Works Director the authority to tie in driveways to the street if the property owner so desires as we pave streets.
