Manager said Council had been pretty much following this policy. Ed Rogers, Comptroller of Keltec was asked by the City ~qanager I who they used as local attorney, and if they had an attorney to advise them or who was available to them. He suggested using their attorney and the City' s attorney to clean up the language and then both parties would be able to go further. Mr. Tomlin- son said if were talking about objection, he wouldn' t make an issue of it, and he was willing to go back to what had been originally drawn and discussed. Attorney stressed that the lease should have limitation on use of the building for industry and be braod enough if Keltec turned over their operation to someone else. Mr. Tomlinson said he would rather the City put limitation on it that they recognized it was an Industrial Park, and that was what it was designed for. Mr. Rogers of Keltec asked if the additions made by Keltec were stricken, if that would leave a document agreeable to the City or would there be any objection to that. Attorney mentioned again that he felt the City should exercise the right to restrict all type operations permitted in the tract. Mr. Tomlinson said they certainly didn' t have any objection to the City putting limitation on what they would do, since they would be doing nothing other than what they were now doing. City Attorney said apparently that could be worked out. then, He said he didn' t anything wrong with the lease other than see adding the restrictions they were talking about. Manager said that it could be given Attorney Smith to go over with Keltec, and that the Finance Director be given the authority to see if he could find financing on this building and maybe by Tuesday would be able to give a definite answer. Mr. Tomlinson said Keltec was in a real bind for room and in I fact they were loosing business as a result of not having relocated. Manager suggested that this route be taken and it would give the Finance Director an opportunity to see about financing so Council would be able to give a decision. 124 Mr. Tomlinson asked what the schedule of events would be, assuming everything were affirmative next week. Mayor Pro Tern Rigdon said if everything could be worked out, financing, etc., to get plans and specifications based on other buildings now working, probably 60 to 90 days. Manager said it would be 90 days before could break ground and probably after that a 4 months contract. Manager told Mr. Tomlinson that Council should have an answer for him Tuesday night, and would appreciate his coming down. Mr. Rigdon thanked Mr. Tomlinson stating that they wanted to work something out and wanted to see if could work it out to locate them in the Industrial Park. Mr. Tomlinson said he was beginning to wonder very much if the City did want anybody out there. Mr. Walker invited him to come to the Tuesday night meeting at 7: 30 p. m. City Manager discussed with Council the drainage problem in the area of M~. Blake' s Pembroke SID containing eight lots and Mr. request for water on those lots. Blakes He said that Mr. Blake had gotten the County to agree that if the City did provide water that they would not require the City to sell the system to the County when the County was able to provide the water. Mr. Rigdon commented that the County had taken all wraps off all water. Mr. Rigdon said he was opposed to going outside the City and furnishing water. Mr. Ready asked why Mr. Blake didn' t bring this subdivision into the City. Manager said the City didn' t have the legal means to annex anybody to the City at the present time; that there was a bill working in the Legislature. He said currently it could only be done by holding an election which was too expensive for only eight lots. He said it would also be extremely difficult to serve sewage to this subdivision. He said Mr. Blake was actually selling individual lots rather than developing lots themselves. Manager said there were about three or four lots on the water. MR. Rigdon said a group of Mary Esther Cutoff residents had just approached him about wanting water but didn' t want to come into the City. He said there was a water shortage right now. He said if you added more customers outside the City Limits it just meant more phone calls. 125 Ken Ross of WFTW Radio Station told Council that Mr. Blake had told the County Commissioners that he planned to build 40 to 60 thousand dollar homes there. Manager spoke to the drainage problem in that Council about area. He said City Engineer asked a State Drainage Engineer' our I about running drainage for a portion of Country Club Estates and Kenwood SID and he told Joe Morgan where to run it. Now that the line is run, residents are objecting and the City needs easements which Mr. Blake verbally agreed to give to run drainage into the Bayou. He said this was everybody' s problem and since the time Mr. Morgan contacted the State Engineer he did not remember the instructions and says the State has no responsibility there. He. said everybody had a problem, the State, the City, and the County. Council asked Mr. Blakeh objection to coming into the City. Manager said the City needed easement for water to forestall lawsuits that Mr. Bunge was real upset about the drainage as was Dr. Giesen, and an Air Force Major. He reminded Council of their approval of the 12" main in the Ocean City area tying back into Fort Walton Beach and the bueget would have a proposal for anew well in the western section of Fort Walton Beach which he felt would begin to balance water pressures. Mr. Ready said he felt Mr. Blake deserved quite a bit of consideration that he was one of the better builders. He said he was helping to put good houses on the tax rolls in the City, and he thought definitely should be considered before Council turned him down flat. Mr. Rigdon agreed that Mr. Blake was a good builder, but maybe some poor wanted water and the Council turned him down, and man in his opinion they all' looked alike. Mr. REady he didn' t mean to misconstrue that he wanted to said help this and not help somebody else but he felt Mr. Blake man deserved some consideration. He said there was about 110 acres in that area he brought into the City and he was sure he would annex this sub- division if the City could give him sewage. Ken Ross of WFTW asked if the legislation had not passed the House. City Attorney said he understood that it had, but had not. heard of its status in the SEnate. I Mr. Ready said he was sure Mr. Blake, 1r he could annex would be one of the first to do so. Someone asked that when he annexed the large portions of property why he didn' t annex Pembroke SID at that time. Mr. Ready asked if Mr. Blake owned it at that time. No one knew. 126 Mr. said he was not against Mr. Blake but was for keeping Rigdon water inside boundaries of City limits and if we gave water to Mr. Blake would have right to furnish everybody in surrounding areas of Fort Walton Beach City limits with water. Mr. REady suggested that Council wait for the outcome of the legislation. Mr. Killingsworth suggested that possibly Mr. Blake might give the City a letter stating he wished to be annexed if it were to become possible. Mr. Killingsworth moved that this be tabled pending outcome of legislation. Motion seconded by MR. Sconiers and carried unanimously. City Manager presented quotation for updating the City' s radio equipment to be in line with the requirements for the new Public Safety Building which would give better range to the remote units in City vehicles in the amount of $ 3, 120. 00 and requested permission to advertise for bids for this updating. Manager said present units did not give completely satisfactory performance, and this would extend the range. Mr. Killingsworth moved that this permission be granted. Motion seconded by Mr. Ready. Mr. Sconiers asked if City could get a radio man in to check our radios, first. He said the radios he worked with, 25 watt GE tube type had 20 mile range. He asked if mayble City could get Mr. Whitaker to check the equipment since he had done such good work on the Vitro radios. Manager said he had tried to get Mr. Whitaker but he was so busy had not been able to get him down to Fort Walton Beach. Mr. Sconiers said Mr. Whitaker had told him he would come on a call basis to the Fire Dept. for their radios any time he called, and he felt would only cost $ 50. 00 to get them all tuned up. Manager said all 23 units needed it. Mr. Sconiers said it was not a real big job. Mr. since he had experience with remote radio Rigdon disagreed units and Mr. Whitaker' s work had not done that much for those he worked with. Vote was taken as follows: Aye: Ready, Rigdon, Killingsworth Nay: Sconiers Motion failed. Meeting adjourned at 6: 30 p. m. for an informal discussion of the new budget. APPRO~ MAYOR: ATTEST: City Clerk
