SUBJECT: Public Hearing - Vacate a Portion of Alley in Blk 7 Bay View Subdivision

STATEMENT OF ISSUE: Mark Siner, P. E., Choctaw Engineering, Inc. On behalf of Fortune
900 LLC, is petitioning the Board of County Commissioners to vacate a portion of the North-
South alleyway through Block 7 of the Bay View Subdivision in the Ocean City Area.
BACKGROUND: Portions of the alleyway in the Bay View Subdivision have been previously
vacated. Fortune 900 LLC, the owner, is requesting the County to vacate the north 150' of the
unopened alleyway in Block 7. If approved, Fortune 900 LLC will receive the full width of the
alleyway being 20' x 150' as they are owners of both of the adjoining parcels. In addition, the
vacation is being requested without stipulations except that which reserves a full width utility
easement for all licensed utility companies including a stormwater/drainage easement for the
County.
OPTIONS: Approve/Disapprove the vacation of said right-of-way as requested.
RECOMMENDATIONS: Approve the vacation of said right-of-way as requested.
