The current process requires approximately 5 months, 2 hearings by the Municipal Planning Board, 3 by City Council. That does not include the additional time necessary to process amendments to the City' s land use and zoning maps, which require adoption of two more ordinances. These lengthy processes often deter persons who might otherwise consider voluntarily annexing to the city limits. For others who are seeking immediate relief from failing water wells or septic tanks, the protracted time period causes unnecessary delays. The process for amending the City' s Code regarding annexation is by adoption of an ordinance. Staff has drafted an amendment to the City Code of Ordinances where the current process is found, Chapter 2, Section 2- 5. Annexation requests. The draft amendment presented in Ordinance 1464 shortens the current process to the minimum required by General Law ( Chapter 171, Florida Statutes), while maintaining the process and procedures for scrutiny available in the current code. The Municipal Planning Board held a public hearing on February 7, 2002 on the proposed Ordinance ( draft 1- 29-02). There was no public comment. The City Attorney' s Office provided a written recommendation to the Board with several changes to the form of the ordinance. The Municipal Planning Board voted 5- 0 to P H- 2. forward Ordinance 1464 to City Council with the changes recommended by the City Attorney. ( Lambert and Gercak were absent). Staff made the changes suggested and they appear in Ordinance 1464 ( Draft 2- 8-02), attached. The City Attorney' s Office reviewed the changes and concurred in their February 11, 2002 Memorandum, also attached. DISCUSSION: The staff has drafted ordinance 1464 with the intent of devising a process that meets the requirements of General Law and removes the City' s preliminary annexation process. The latter adds at least seven ( 7) weeks to the overall annexation process. Staff believes that the same oversight can be accomplished concurrently with the development of the usual staff reports necessary to process an annexing ordinance, and ordinances which designate a FLUM category and zone the newly annexed property, without the need for the present preliminary process. Much of the current language in Section 2-5 is administrative procedure that should be put in place as administrative policy. Section III. of Ordinance 1464 includes the language proposed to be inserted in lieu of the current language. The Ordinance proposes seven ( 7) sub- sections entitled purpose, application, staff review and
