SITE PLAN APPROVAL Apartments located at 111- 119 Shell Avenue SE and 106- 108

The City Attorney stated since this is a site specific

SITE PLAN- DOLPHIN The City Attorney swore in Randy Stokes, Architect, Stokes
APTS. ( CONT) Associates; Kenneth Rowland, Applicant; and Malcolm Foley,
Interim CDS Director, as witnesses in the proceeding.
Mr. Stokes testified that all of Staff' s concerns have been
resolved, that
buildings that are presently on
the the site
will be torn down, and presented a sketch of how the
finished project will look.

It was explained to Council that the project is
intended for long term use and that is why Phase I will be
built in a timely matter, with amenities and Phase II will
be completed shortly thereafter. The applicant loses site
plan approval for Phase II of the project if not started in
a timely matter, and the site plan approval is conditioned
upon the project not being operated as a commercial or
transient facility. To do so would also be a violation of
code enforcement.
The City Attorney asked if there
was any objection to the
admission into the record of Agenda package as Exhibit
the
1 and the sketch of the finished product of Dolphin Studio
Apartments as Exhibit 2. As there were no objections, the
Mayor entered the exhibits into the official quasi- judicial
file of Dolphin Apartments.
Kenneth Rowland, Applicant, stated the apartments will be
geared toward working people, retirees, and the military,
and the need does exist for nice, low- maintenance housing.
Mr. Covey moved to approve the Final Site Plan for the
Dolphin Studio Apartments subject to the following
conditions: 1) The warranty deeds transferring the subject
right- of- ways shall be dated and executed in favor of the
City prior to Final Site Plan approval for the development
and prior to adoption of Ord. ' 1350; 2) a stormwater
management plan and a utility plan shall be approved by the
Engineering Division prior to the issuance of a building
permit; 3) a landscape plan shall be submitted to and
approved by the Planning and Zoning Division prior to the
issuance of a building permit for the development. Said
plan shall identify all proposed landscape material,
irrigation system and shall depict the preservation of as
many existing trees on the site as possible; 4) the new
