BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: July 21, 2015 TO: Honorable Chairman and Members of the Board FROM: Jason Autrey SUBJECT: Amendment #1 to FIM Blvd Right of Way Easement with Eglin AFB DEPARTMENT: Public Works BCC DISTRICT: District: 3 STATEMENT OF ISSUE: Approval of easement #FTFA-15-2-0262 (which replaced DACA- 01-2-90-280) for right-of-way along federal property for FIM Blvd was approved on March 17, 2015. That easement included an additional 33' in width along a 1330' run to the west on private parcels. At this time, an additional easement is being requested (via amendment) for 25 years with no fees. BACKGROUND: Eglin Air Force Base initially granted a 25-year easement for the construction and maintenance of FIM Boulevard (formerly Duval Road) in March, 1990. That easement was to expire on March 26, 2015. Public Works staff has been working with the Eglin Real Estate Department to acquire additional right-of-way through Eglin property for a continuation of FIM Boulevard. The request is for 33' of right-of-way along the south boundary of private commercial property at the existing end of FIM Boulevard. This location consists of a private, dirt roadway. Adjacent business owners have requested improvements to the roadway, however these improvements can not be performed by the County without the proposed easement in place. Additional right-of-way from adjacent private parcels may also be required to accommodate future improvements. In an effort to consolidate both the existing roadway and new right-of-way easements into a single document the attached amendment has been provided by Eglin Real Estate for execution by the Board of County Commissioners. Along with combining the two easements into a single document, standard easement stipulations have been clarified because of the potential for land clearing and roadway improvements. Upon reception of this additional documentation, Eglin will approve and finalize the amended easement thereby granting the easement to the County. OPTIONS: Approve/Disapprove authorization and execution of the amended right-of-way easement for submission to the Eglin Real Estate Department.
