motion was made and the time Council votEd, there was a lot of discussion. The City Manager again asked for clarification, whether he is allowed to sell one piece of property on Lovej oy Road and not the property on Ready Avenue, or is he directed to sell both pieces of property. Mr.deVaux said he understood if Bill Stone neEded to buy one or the other, he could buy them both. if he didn' t need to buy them then he doesn' t neEd to buy them. Mr. Keeler said that is what the motion said, that is not what the' bid said. The Mayor I said to do what the bid said. Mr. Rosenbaum said it is still an option. Mr. deVaux saio that is what Council voted on. The Mayor said that is what the motion said, but that is not what the bid said. The City Attorney suggested if, as he perceived, the intent of Council in that prior motion that awarded the bid was contrary to the motion that was read, then staff requires motion that and that a to clarify is what brought everyone here. 242 4- 10/ 11- 90 INDU PARK ( STRIA!. CONT . ) The City Attorney then said he suggested, as he perceived from the maj ority of Council' s comments, that that should be the same motion Mr. Rosenbaum made last night to amend the prior motion. The City Attorney advised a motion to amend the prior motion is needed. Mr. Rosenbaum moved that the prior motion be amended to award the purchase of the property to Mr. Stone at the prices as bid, ($ 25, 077. 65 for the Lovejoy Road property, and $ 21, 285. 47 for the Ready Avenue property), subject to the request for proposal. The City Attorney said to include, at the bid submitted. Mr. Rosenbaum said, at the price submitted. The City Attorney then recommended the adoption of the motion. Mr. Maney seconded the motion. Mr. Melvin asked if that meant PASARDA is permitted to go into the Industrial Park. Mr. Rosenbaum said that is what the RFP said. Mr. Merriwether asked if they are going to allow PASARDA to be moved from that piece of property to another piece of property in the Industrial Park. The Mayor stated that is just as it was advertised. Mr. Merriwether then asked if that was correct. The City Attorney answered no, but he gave Council that opinion when they awarded it, but that is how it was advertised. Mr. Rosenbaum rematked that the City Attorney is right, if Council approves this it will get them off the legal hock. He said he did not believe Council is subject to a lawsuit if they adopt the motion. The Mayor called for the vote on the motion and it carried by a vote of 6 to 1, with Rosenbaum, deVaux, Wyatt, Maney, Merriwether, and Wyninegar in favor, and Smith opposed.
