RFP says, after they pay the cash.
Mr. Wyatt suggested there is one more option, if the
two firms both withdraw their bids, that would scilve
the whole problem. Mr. Melvin said if Mr. Stone will
withdraw his, Aero Tech will withdraw theirs.
Mr. Stone said he is not
sure he is willing to do that
considering what is
going on through this proceeding.
He then asked Mrs. Wyninegar if she had a specific
objection to continuing to award him the bid.

INDU STRIAL PARK ( CONT . ) Mrs. Wyninegar explained her objection to giving
ownership to PASARDA in the Industrial Pa:rk. Mr.
Stone then presented information on the business he
intends to put in the Industrial Pa:rk. He then
rema:rked on the bad publicity generated by this
situation and the accusations made of him. He further
expressed his feeling that it is unfair C9uncil is
considering rescinding the bid.
The Mayor pointed out the reason this item came back
before Council is because they believed they voted as
the bid was advertised, then Mr. Stone wanted to close
on one parcel and not both parcels. Mr. Stone
explained his reason for wanting to close on one
parcel. Mr. Merriwether explained he requested the
City Manager bring this item back before Council when
he learned there was a difference on what they voted
on and what was taking place. The City Manager
explained he gave a written report to Council, with a
copy provided to Mr. Stone, that his recommendation to
the Mayor was not to sign the deed until Council
readdressed this issue.
Ryan Fisher said, for the benefit of the public who
are present looking for answers to this situation,
said he would like to know if Mr. Stone ever refused
to live up to his
obligations on
was the bid that
awarded to him; specifically, has Mr. Stone refused to
purchase both parcels of property. He also wished to
know if Mr. Stone has, in fact, transferred money or
in any way given money City to the for both tracts,
and has that money been accepted by staff, or Council,
or a representative of the City, for the purpose of
closing. The City Manager answered yes. The Mayor
said the City has both checks for both parcels. Mr.
Fisher rema:rked that Mr. Stone has then demonstrated
his willingness to finish the deal. The Mayor said
the bid advertisement was to close on both parcels,
Mr. Stone returned and asked to close on the Lovejoy
parcel. Mr. Fisher
of those then asked, in view
things, if Council is ready to make Mr. Stone live up
to his obligation that he willingly undertock by
bidding on those parcels that were awarded to him,
with no changes, as he has agreed to do; if Council is
still willing to support their decision based on what
they thought they were voting on. The Mayor said that
will be determined with the vote.
The Mayor repeated that the motion on the floor is to
rescind the award of bid to Bill Stone. He then
called for the vote on the motion and it failed by a
vote of 5 to 2, with Rosenbaum, deVaux, Wyatt, Maney,
and Wyninegar opposed, and Smith and Merriwether in
favor.

INDU STRIA!..
PARK ( CONT . ) The City Attorney said he thought the City Manager
should report to Council what his expectation is and
suggested it is the intent as Mr. Rosenbaum outlined
in his recent statement about what his intent was in
the original motion when the bid was awarded. He said
if there is anything contrary to that, his
recommendation to management would be to follow the
intent Mr. Rosenbaum described, as that is different
I
than the motion made.
Mr. Rosenbaum said that is the motion that Council did
not rescind. Mr. Wyatt asked, based on the
transaction, if the facility has to be built starting
in six months. The City Manager said based on the bid
specs, within a year of the date the bid was awarded a
facility has to be in place for PASARDA and PASARDA
has to accept it; PASARDA in turn will receive the
deed. He said he neEds an instruction from Council.
is the building supposed to be on Ready Avenue in
Industrial Park, is it supposed to be any where; he
or
said that is
problem.theThe City Attorney asked
what the RFP said, and the City Manager said it says
in the Industrial Park on Ready Avenue. Mr. Rosenbaum
said that answers the question. The City Manager said
it will be according to specifications.
The Mayor said the motion Council votEd on last time
enabled Bill Stone to close on one piece of property.
Mr. Rosenbaum said that was not specific in the
motion. The
City Manager remarked he thinks so. Mr.
Rosenbaum then read the motion from the last meeting.
Mr. Wyatt then asked when the motion was written down
if staff had to go back to get the actual language
from Mr. Rosenbaum or if they had it at that time.
The response was the motion was taken from the tape,
verbatim. Mr. Wyatt remarked from the time the
