DATE City of Fort Walton Beach = P&-—#&# Americar Most Geautijuk Beaches Oy Py 1271 AN ORDINANCE OF THE CITY OF FORT WALTON BEACH RELATING TO DESIGNATING A ZONING DISTRICT FOR CERTAIN PROPERTY WITHIN THE CITY OF FORT WALTON BEACH LOCATED AT 625 COUNTRY CLUB AVENUE, N.E., LOT 14, BLOCK 8B, COUNTRY CLUB ESTATES SUBDIVISION: PROVIDING FOR AUTHORITY: PROVIDING FOR FINDINGS OF FACT: PROVIDING FOR PROPERTY T0 BE ZONED R-1A, (SINGLE FAMILY DWELLING DISTRICT) AND PROVIDING FOR AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WALTON BEACH, FLORIDA, AS FOLLOWS: SECTION 1. AUTHORITY. The authority for enactment of this ordinance is Section 2 of the City Charter, and Section 166.021(1), Florida Statutes. SECTION 2. FINDINGS OF FACT. The City Council of the City of Fort Walton Beach finds the following: A. That the fee simple title holders of the property described in this ordinance have submitted a request to zone said property: and B. All required public hearings have been held before the Municipal Planning Board and the City Council of Fort Walton Beach, and the Municipal Planning Board has recommended the request be approved; and C. That the property is located at 625 Country Club Avenue N.E. and is legally described below; and D. That the zoning is consistent with the present comprehensive plan. SECTION 3. PROPERTY REZONED. The following described property is hereby zoned R-1A (Single Family Dwelling District): Lot 14, Block B, Country Club Estates Subdivision. SECTION 4. EFFECTIVE DATE. The effective date of this Ordinance shall be the date a final order is issued by the Department of Community Affairs or Administrative Commission finding the Future Land Use Amendment in Compliance in accordance with Section 163.3184, Florida Statutes, whichever occurs” earlier, No development orders, development permits, or land uses dependent on this Ordinance may be issued or commence before it has become effective. If a final order of noncompliance is issued, this Ordinance may nevertheless be made effective by the adoption of a resolution affirming its effective status, a copy of which resolution shall be sent to the Department of Community Affairs, Bureau of Local Planning, 2740 Centerview Drive, Tallahassee, Florida 32399-2100. The resolution shall not become effective until receipt of written notice from the Department of Community Affairs that it has received the resolution.
