PUBLIC HEARING - RESOLUTION PROVIDING NOTICE OF INTENT TO USE
NON-AD VALOREM COLLECTICN TO RECOVER COSTS OF ABATING NUISANCES
AND CODE VIOLATIONS
Mr. Stewart stated the purpose of this hearing is to consider
adoption of a resolution for a Notice of Intent to use non-ad
valorem collection to recover the costs of abatement of nuisance
and Code violations.
Mr. Elliot Kampert, Growth Management Director, stated approval
of this measure gives "“another arrow in the quiver” for Code
Enforcement. He said it does not allow for collection of fines
and fees but will only apply to mediation. Mr. Kampert advised
the resolution must be adopted prior to January 1 1in order for
it to be used on next year’s tax assessment.
Mr. Stewart confirmed the resolution must be adopted prior to
January 1. He stated adoption of the resolution will not commit
the Board to go forward with adoption of the ordinance or even
to impose the assessments. However, if the resolution is not
adopted, the Board will not have the option of including and
collecting those assessments on the ad valorem tax bill. He
termed it a procedural step. (The primary purpose of the Notice
of Intent 1is to notify the Property Appraiser and Tax Collection
that assessment may be imposed.)
No one came forward to speak in favor of or in opposition to the
draft resolution.
Mr. Windes made motion, seconded by Mrs. Ketchel, to adopt the
resolution as presented. 4 yeas, 1 nay. (Mr. Harris voted no.)

PUBLIC HEARING - REQUEST FROM WATREE CONSTRUCTION AND LAND
DEVELOPING TO AMEND RESOLUTION NO. 6G-200
Mr. Stewart stated the item before the Board is a petition to
amending Resolution No. 6G-200 by removing Stipulation #4. This
resolution previously vacated Ninth Street right-of-way adjacent
to Lot 1 Block 31 in the Townsite of Port Dixie (Shalimar).
Stipulation #4 of 6G-200 prohibits further subdivision of the
property.
Mr. Jason Autrey, Public Works Director, reported the petition
to amend the resolution was submitted by Watree Construction,
saying the company would like to re-subdivide or lot-split to
have three parcels fronting Ninth Street. He said originally
the plan (in 1984) was for three lots and this request is for
three lots. The lots are currently platted as 30 feet wide and
150 feet deep. Because this 1s not very desirable for
construction, the petitioner would like to change the position
of the houses and make each lot 50 feet wide by 100 feet deep.
Mr. Autrey stated the Public Works Department has no objection
and no objection has been received from the public.
Mr. Nathan Harris, Operations Manager for Watree Construction
and Land Developing, stated he submitted the request on behalf
of the current owners. He advised that the property is under
contract for purchase. Mr. Nathan Harris stated the proposal
will not increase density.
Mr. Steven Schrader, adjacent property owner, asked what will be
built. Mr. Boyles replied the zoning is not being changed and
whatever could be constructed today will be the same thing which
can be constructed if the stipulation is removed. Mrs. Ketchel
commented that she has been in contact with Watree Construction
and it 1is her understanding three homes will be built. Mr.
Nathan Harris said the intent 1s to build three detached,
single-family dwellings.
Mrs. Ketchel made motion, seconded by Mr. Harris, to adopt the
proposed resolution amending Resolution 6G-200 by removing
Stipulation #4. 5 yeas.

PUBLIC HEARING - RESOLUTION PROVIDING NOTICE OF INTENT TO USE
NON-AD VALOREM COLLECTION FOR DRAINAGE FACILITIES AND ROAD
PAVING IMPROVEMENTS FOR FOREST SHORES DRIVE AND OLD HICKORY
ROAD-GIBBS DRIVE
Mr. Stewart stated the issue before the Board in this hearing is
use of the non-ad valorem ccllection process for improvements to
Forest Shores Drive in Mary Esther and 0Old Hickory Rcad-Gibbs
Drive in Crestview. He advised the commissioners that adopticn
of the resolution for Notice of Intent does not bind them to go
forward.
Mr. Autrey stated approval of this process is a separate piece
of the previous Notice of Intent to use the non-ad valorem
collection process for improvements in The Pines and Triple
Lakes Estates Subdivisicns. He noted this public hearing was
originally set to consider four roads but property owners along
two roads have decided to move away from this process.
No one came forward to speak in favor of or in opposition to
this proposed resolution.
Mr. Harris made motion, seccnded by Mr. Goodwin, to adopt the
resolution providing Notice of Intent to use non-ad valorem
collection for drainage and paving improvements to Forest Shores
