BOARD OF COUNTY COMMISSIONERS
AGENDA REQUEST
DATE: October 21, 2014
TO: Honorable Chairman and Members of the Board
FROM: Jason Autrey
SUBJECT: Surplus Property Disposal - Unrecognized Right of Way
DEPARTMENT: Public Works
BCC DISTRICT: 4
STATEMENT OF ISSUE: Adopt and execute an agreement and quit claim deed between
Okaloosa County and Mr. Barry Gray to dispose of surplus property adjacent to Poplar and
Elaine Ave NW in Fort Walton Beach.
BACKGROUND: In January of 2000, Okaloosa County was deeded a parcel of land intended to
be used as right of way. The County never formally accepted the deed and staff finds that it fills
no need for Public Works. Additionally, the property contains a derelict structure that may
encroach upon other privately owned property.
Mr. Barry Gray approached the County with an offer to take over the parcel and remove the
derelict structure within 120 days of execution of the deed and agreement. In accordance with
Title XI Chapter 125.35(2) of the Florida Statutes, the County has notified adjacent property
owners of our intent to dispose of the property. Additionally, the Statute requires that we
provide a 10 business day opportunity for adjacent owners to submit a bid to purchase the parcel
if they have interest in doing so. That window has passed and we have received no written offers
for purchase of the property from adjacent owners.
The County Attorney assisted with and approved the Real Property Transfer Agreement and Quit
Claim Deed associated with this request. In addition, counsel approved the adjacent property
public notice to meet the statutory compliance requirements. Having satisfied the statutory
requirements, staff now recommends proceeding with the execution of the agreement and
disposal of the property to Mr. Gray.
OPTIONS: Approve/Disapprove acceptance of agreement and allow chairman to execute both
the agreement and deed and allow recording of the same.
RECOMMENDATIONS: Approve the acceptance of agreement and allow chairman to execute
both the agreement and deed and allow recording of the same.
RECOMMENDED BY:
APPROVED BY:
John Hofstad, Interim County Administrator
