Re: O' Daniels v. City of Fort Walton Beach
Division of Administrative Hearings Case 2007- 954
On 2 May 2007, I filed the City' s Motion to Strike, Motion to Relinquish Jurisdiction,
Motion for Attorney's Fee and Costs, and Request for Hearing. On 16 May 2007, the Court
rendered its order on those motions. Both documents are included for your review. The Court has
detennined that
issues related to off-site flooding allegedly caused by the pennitted project
appear to be within the scope of DEP' s review of the pennit and, therefore, this
proceeding could conceivably result in additional pennit conditions on those
issues. See, e. g., Fla. Admin. Code R. 62- 600, 62- 61 0.400( I), 62- 610.414, 62-
610.417, 62- 620. 610 through 62- 620. 630, 62- 640. Because there appear to be
disputed issues of material fact regarding those issues, it would be inappropriate
to relinquish jurisdiction to DEP at this stage of the proceeding."
The DEP attorney, Mr. Schwartz is leaving the DEP for private employment. Another
attorney, unfamiliar with the case, is taking over for him. We have filed a joint motion to
continue the case which will result in the trial currently scheduled for June 5- 6 to be rescheduled.
As a result of the Court' s order and the DEP' s attorney swap, I feel that I need the
assistance of co- counsel and an expert to best protect the City' s interest. Mrs. Brownless has
agreed to assist me with the case. At this time, I do not know who will be or the cost for the
expert to evaluate the case and testifY for the City. I will bring that back to Council, if necessary.
I expect that the cost will be within the City Manager' s spending authority and will not require
Council approval.
I request authorization to retain Mrs. Brownless as co- counsel in this matter.
