Tim Bolduc, Development Services Manager, advised since 1976 the City has participated in the
National Flood Insurance Program (NFIP) and that participation in the program requires the city
to adopt and maintain certain floodplain management regulations and standards as well as a set
of corresponding floodplain maps. Mr. Bolduc continued the Land Development Code ( LDC)
must be updated to reflect the most recent changes provided for floodplain management
regulations, and Ordinance 1865 will become effective with the revised LDC on May 1, 2012.

ORDINANCES -- SECOND READING
1860 Amends FLUM for Bayou Woods Lots 1 to 7
AN ORDINANCE OF THE CITY OF FORT WALTON BEACH, FLORIDA AMENDING
THE CITY'S COMPREHENSIVE PLAN TO AMEND THE FUTURE LAND USE MAP FOR
PROPERTY LOCATED AT BAYOU WOODS LOTS 1 TO 7, INCLUSIVE, BLOCK 3 FROM
REC ( RECREATION) TO LDR ( LOW DENSITY RESIDENTIAL); PROVIDING FOR
AUTHORITY; PROVIDING FOR FINDINGS OF FACT; PROVIDING FOR CONSISTENCY;
PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.
Stella Jones, City Planner, advised there are no changes to the ordinance since first reading and
Staff recommends approval.
Steve Media, environmental lawyer representing the Harkins family, discussed possible
contamination of the site and legal challenges the City could face if this ordinance is approved.
Brett Harkins, 110 Sotir Street, suggested that Council may want to consider tabling the issue for
now to gather more information for other uses for the property, such as a City park or
playground, and further discussed his concerns regarding possible contamination on the property.
Christine Gleason, 221 Bayou Woods Drive, questioned if the residents purchased the property
could it be left as a field. The City Manager advised the code requires a bid process and that the
sale would go to the highest bidder, and that it could be used however the purchaser desired as
long as it is in the City's LDC.
Samuel Harkins, 110 Sotir Street, raised concerns regarding possible toxins in the land that could
make people sick.
Discussion included that this ordinance only changes the land use and does not approve any
development, and if the property is developed further environmental studies would be done at
that time.
Mr. Nabors moved to adopt Ordinance 1860 on second reading and it died for lack of a second
