BACKGROUND: Okaloosa County Department of Corrections entered into a contract with ABL Management, Inc. in September 2012 to provide food services to the Department of Corrections. The contract includes a provision to provide meals to staff and visitors. Finance staff questioned whether or not the meals for staff should be a taxable benefit. This issue was resolved by establishing a written policy authorizing "One meal per shift may be provided to correctional officers on duty and on premises by the contracted inmate food services provider at no cost to correctional officers who are not routinely permitted to leave the premises. Meals may be provided because of the nature of the work, because lunch periods must be kept short, and to ensure adequate staff is always available to respond to emergencies. The intent of this policy is not to provide additional (taxable) benefit to the correctional officer." The intent of this amendment is to clarify language regarding the provision of meals to on-duty correctional officers, to delete the provision of meals to visitors and to satisfy the concern regarding any taxable benefit related to the provision of meals to correctional officers. The contract will be amended to read: “Preparation and serving of one standard meal per shift upon request to correctional officers who are on duty. Correctional officer meals will be identified on the invoice separately from inmate meals.” In all other respects, the terms and conditions of the Contract shall continue unchanged and in full force and effect. OPTIONS: Approve or Disapprove RECOMMENDATIONS: Approve the contract amendment as stated above. RECOMMENDED BY: Packet Pg. 299 8.12 APPROVED BY: James D. Curry, County Administrator Packet Pg. 300 8.12.a Packet Pg. 301 Attachment: ABL Contract Amendment (1525 : ABL Contract Amendment)
