initiated by filing with the Utilities Director a written petition containing the name of owner, a legal description of the real property affected, a summary description of the asserted error, or basis for exemption, variance, or mitigation, and the relief requested of the City. Such petition may be considered by the City at any regular or special meeting, with notice being provided to the petitioner. The City may wish to establish a Stormwater Utility Appeals Committee, and delegate to such Committee the authority and responsibility to hear such petitions. CITY OF FORT WALTON BEACH STORMWATER UTILITY IMPLEMENTATION PLAN REPORT TETRA TECH 32 May 28, 2008 8.0 BILLING AND COLLECTION OF USER FEES Stormwater Utility Fees shall be collected and enforced in the same manner that water, wastewater, and solid waste fees are collected and enforced. Most municipalities choose to collect stormwater fees using this method. A recent 2007 Stormwater Utility Survey by Black and Veatch reported that based on 71 utilities in 22 states, 77% of them use utility billing to collect stormwater fees while 16% use tax bills, and 7% bill and collect by other means. Typically, eight out of ten Florida Stormwater Utilities use utility bills to collect stormwater fees. Collection of the fee through an existing utility is usually straightforward and cost effective when compared to the effort required for collecting the fee on a separate bill. Failure to pay the monthly Stormwater Utility Fees in the required manner will result in the termination of water service to the subject property in accordance with existing City Ordinance that established the protocol associated with termination of service activities. For non -metered customers, the City shall develop a field within its current billing system to generate a bill on a semi -annual basis to collect stormwater fees from those parcels. For these parcels a different enforcement mechanism shall be utilized such as filing a lien against parties that do not pay their bill. There is no special notice requirements of the City for using the existing utility bill with the exception of the City's established requirements related to passing ordinances and resolutions. Upon Council's acceptance of the stormwater utility ordinance and resolution establishing the base rate amount per ERU, Tetra Tech shall provide the City with a database capable of being merged with HTE Utility Billing software that includes the GIS sampling for single and non -single family residential parcels and assigns the ERU billing rate to all single -family residential properties. As part of the protocol to establishing a water service account, the City should begin including a requirement for all new accounts to report the amount of impervious area as part of the water connection/tap application. This information can be included when the new account is registered, thereby creating the field required to collect stormwater user fees. It is also recommended that the City update the utility service agreement or contract executed by utility customers describing the City's right to disconnect water service for non -payment of stormwater utility fees. The existing language in the City's agreement/contract may suffice but should be examined by legal counsel for recommended revisions. CITY OF FORT WALTON BEACH STORMWATER UTILITY IMPLEMENTATION PLAN REPORT TETRA TECH May 28, 2008 33 9.0 DRAFT STORMWATER UTILITY ORDINANCE A draft stormwater utility ordinance and draft stormwater utility rate resolution are provided in Appendix E for the City's review and comment. CITY OF FORT WALTON BEACH STORMWATER UTILITY IMPLEMENTATION PLAN REPORT TETRA TECH May 28, 2008 34 10. 0 CONCLUSION This report creates the framework for a citywide stormwater utility. The next step for the City includes satisfying the formal readings, hearings, and other requirements of an ordinance and rate resolution to establish the creation of the utility. Following this action, coordination with City staff will occur to implement the utility as described herein. Items such as finalizing the final utility billing database and coordinating with HTE will then occur.
