READING 1 1st o 2nd o ORDINANCE 1831 AN ORDINANCE OF THE CITY OF FORT WALTON BEACH, FLORIDA, PROVIDING FOR AUTHORITY; PROVIDING FOR FINDINGS OF FACT; PROVIDING FOR PROPERTY DESCRIBED AS 1564 PERCY COLEMAN ROAD, MORE PARTICULARLY DESCRIBED IN THE BODY OF THE ORDINANCE, TO BE REZONED FROM OKALOOSA COUNTY RGD ( RESIDENTIAL GENERAL DEVELOPMENT) TO CITY OF FORT WALTON BEACH CF COMMUNITY FACILITIES) DISTRICT; PROVIDING FOR THE AMENDMENT OF THE AFFECTED PORTION OF THE OFFICIAL ZONING MAP; PROVIDING FOR SEVERABILITY AND PROVIDING FOR AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WALTON BEACH, FLORIDA, AS FOLLOWS: SECTION I. AUTHORITY. The authority for enactment of this ordinance is pursuant to Section 2, of the City Charter of the City of Fort Walton Beach, and Section 166. 021 ( 1), Florida Statutes. SECTION II. FINDINGS OF FACT. The City Council of the City of Fort Walton Beach finds the following: A. That the proposed rezoning is necessary because the subject property currently has no City zoning designation; and B. That the subject area was annexed into the city limits by Ordinance 689; and B. That the Future Land Use Map of the Comprehensive Plan of the City of Fort Walton Beach was amended on August 22, 2000 to designate the subject area for Public Lands PL) land use; and C. That the subject area is comprised of 17. 94 acres of land area, more or less; and D. The Municipal Planning Board held a public hearing on August 5th, 2010, and recommended approval of rezoning the subject area to CF ( Community Facilities) District; and E. Public hearings have been conducted after giving due public notice pursuant to Section 166. 041 ( 3) ( c) 2, Florida Statutes, by the City Council of Fort Walton Beach; and F, That the rezoning is consistent with the present Comprehensive Plan, adopted August 22, 2000, SECTION III. PROPERTY REZONED. The following described property is hereby zoned CF Community Facilities) District: Commencing at a General Land Office monument dated 1937, 2" pipe with brass cap, which is at the quarter section corner common to section 25 and 26, T- 1- S R- 24-W, being also a corner of a tract of land conveyed to the Board of Public Instruction, Okaloosa County, Florida, on 30 December 1970, and a corner of a tract of land owned by the United States of America at Eglin Air Force Base; thence N 87048' 29" W, along the said boundary of said Board of Public Instruction tract which is along the boundary of said United States tract 1150, 83 feet to an unnumbered 4" x 4" concrete monument; thence S 01047'58" W, along the boundary of said Board of Public Instruction tract which is along the boundary of said United States tract 902. 80, feet more or less, to the point of beginning; thence continue S 01047'58" W, 273, 00 feet; thence N 88012' 02" W, 740. 00 feet; thence S 01047'58" W, 399, 90 feet; thence S 90000' 00" W, 803.40 feet, more or less; thence N 01047'58" E, 698, 03 feet; thence S 88012' 02" E, 1543. 00 feet to the point of beginning, The parcel described herein contains 17. 27 acres, more or less and is a portion of Parcel 1 ( Tract 943) as recorded in the Official Records Book 2663, Page 4937, Okaloosa County, Florida, SECTION IV. AMENDMENT OF OFFICIAL ZONING MAP. The Official Zoning Map of the City of Fort Walton Beach is hereby amended to change the zoning classification from Okaloosa County Residential General Development ( RGD) to City of Fort Walton Beach CF Community Facilities) for the specific parcels identified in Section III, above. SECTION V. SEVERABILITY. If any section, phrase, sentence, or portion of this Ordinance is, for any reason, held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions thereof. SECTION VI. EFFECTIVE DATE. This Ordinance shall become effective upon approval by the City Council and signature of the Mayor.
