according Statute staff is supposed to present and be a consultant to the Board, and straighten out the issues at a pUblic hearing and it should not leave the chamber until in they are consensus. He said the Statute does not say that the staff presents a recommendation, it says the Board. The City Attorney stated her opinion is that what the Board is doing is making recommendations regarding planning issues. She said there has never been a discrepancy on quasi-judicial issues because the Board is either accepting the recommendation of staff or they formulate a consensus on the recommendation before it goes to Council; so in quasi-judicial issues there is not an open forum. She said on planning issues they win not hear her say that Council should not hear every recommendation that is possible because that is their job. She noted another underlying policy decision is whether or not designating a secretary from the CDS Department is the same as the staff following in and being the Board' s voice in front of the Council, and she has not heard of anyone else dealing with that issue. Mr. Mitchell stated that staff is the technical advtsors to the Council as well as the Board.
