BOARD OF COUNTY COMMISSIONERS
AGENDA REQUEST
DATE: March 3, 2015
TO: Honorable Chairman and Members of the Board
FROM: Jason Autrey
SUBJECT: Okaloosa Lane right-of-way acquisition
DEPARTMENT: Public Works
BCC DISTRICT: 1
STATEMENT OF ISSUE: As part of the project to improve Okaloosa lane from the current
dirt road condition to a two lane paved road, it is necessary to acquire adequate right-of-way.
Multiple parcels have been identified as necessary to accommodate the improvements and staff
is working on acquiring the necessary land. An agreement in principle has been made with one
of the effected property owners for the purchase of entire parcel of land and staff requests
approval from the Board of County Commissioners to develop necessary documents to acquire
the property.
BACKGROUND: The proposed paving of Okaloosa Lane requires right-of-way adjacent to
property owners along this county maintained roadway. Depending on the location of the
property owner and the existing roadway, the amount of right of way required varies from parcel
to parcel.
In the location of parcel number 22-3N-23-0000-0060-0000 it has been determined that 45' of
right-of-way is required to accommodate the roadway. Staff has been working with the property
owner, Mr. Bobby G. Kennedy, Jr., to acquire the necessary land area. The parcel of land that
Mr. Kennedy owns is approximately one-quarter acre in size and the required right-of-way
represents approximately 23% of the total land area.
The appraisal performed for this parcel determined a value of $2,140 for the necessary right-of-
way. Mr. Kennedy’s concern is that the remainder of his parcel will be too small to
accommodate a residence for future use or sale. Mr. Kennedy has asked staff to consider
acquisition of the full parcel for the amount of $10,000.00. The parcel includes an old,
dilapidated residence of approximately 1,200 SF.
By acquiring the entire parcel, staff can continue to move forward with the planned
improvements to Okaloosa Lane. The remainder of the parcel could be used for staging during
construction, potential ancillary work to the roadway and be available for future use by the
County if needed. Once the project is complete it is possible the remaining portion of the parcel
be declared as surplus for future sale.
Funds for right-of-way acquisition are available as part of the existing project budget. If
approved staff with continue to work with Mr. Kennedy and the County Attorney to develop the
necessary documents for property acquisition. The acceptance of the deed and authorization to
provide payment will be presented to the Board of County Commissioners for final approval at a
future meeting.
OPTIONS: Approve/Disapprove staff to prepare documents for the acquisition of parcel 22-3N-
23-0000-0060-0000 from Mr. Bobby G. Kennedy, Jr. in the amount of $10,000.00 for use as
right-of-way as part of the Okaloosa Lane Improvement project.
RECOMMENDATIONS: Approve staff to prepare documents for the acquisition of parcel 22-
3N-23-0000-0060-0000 from Mr. Bobby G. Kennedy, Jr. in the amount of $10,000.00 for use as
right-of-way as part of the Okaloosa Lane Improvement project.
