PUBLIC HEARING - ECONOMIC DEVELOPMENT AD VALOREM TAX EXEMPTION FOR PROJECT PROUD Mr. Stewart stated the proposed resolution is to grant economic development ad valorem tax exemption for Project Proud. He reported the advertised legal notice did appear in the Northwest Florida Daily News. March 3, 2015 -8- Minute Book 72, Page 188 Okaloosa County Board of County Commissioners Mr. Nathan Sparks, Executive Director of the Economic Development Council (EDC), stated an existing manufacturer relocated from the Northeastern United States to Okaloosa County eleven years ago. He said the company has 100 employees with an average wage of $41,121 and pays full medical insurance for its employees. The company, identified as Project Proud, 1is seeking incentives from the State for 40 new jobs to be created should the company choose to remain in Florida and expand. The average wage of the 40 new employees will be $36,152. The capital investment will be $17 Million within five vyears. Mr. Sparks reported this company is being pursued by other states. He said Governor Scott has become involved and called the out-of-state CEO to discuss the project. The State of Florida is willing to consider providing $256,000 as its 80% match in Qualified Target Industry (QTI) Tax Refund Incentives for creation of the 40 new jobs. All QTI incentives reguire a 20% match from the local government, which for this project is $64,000. Acceptable forms of the 1local match are cash or economic development ad valorem tax exemption. He said the application has been prepared and the Property Appraiser has completed his portion of the form (DR-418). Mr. Sparks stated this exemption would be for a period of seven years. Mr. Harris made motion, seconded by Mr. Windes, to adopt the resolution providing Project Proud with economic development ad valorem tax exemption for a seven-year period (100% exemption totaling $64,000). 5 yeas. RESOLUTION NO. 15-61 AIRPORTS - PROPOSED SETTLEMENT AGREEMENT FOR DESTIN JET TO OPERATE BOTH FBOS AT DESTIN EXECUTIVE AIRPORT Mr. Sunil Harman, Airports Director, requested Board approval of a proposed settlement agreement with negotiated terms for Destin Jet to operate both Fixed Base Operations (FBOs)—-Destin Jet and Regal Air Destin—in exchange for mitigating declining airport revenues by increasing fuel flowage fees and accelerated repayment of Regal Air Destin’s debt at Destin Executive Airport. The action will also require approval of amendments to both FBO leases. Mr. Harman stated staff believes this agreement will provide a significant advantage to the county with regard to revenues, saying staff believes it is fair and equitable. He stated it will be beneficial in helping mitigate the impact the community March 3, 2015 -9- Minute Book 72, Page 189 Okaloosa County Board of County Commissioners has suffered since at 1least 2008 when the last noise impact survey was conducted. Mr. Harman said with approval of this agreement he intends to return for approval of funding for certain mitigation projects. Mr. Boyles requested clarification in connecting noise mitigation with the two lease amendments. Mr. Harman replied the community members have been anticipating improvements since 2008 which should have been implemented with the availability of federal funds. He said those funds never came about. Upon further inquiry by Mr. Harris, Mr. Harman said staff’s intent is to use the additional vrevenue to match State dollars on an incremental basis. Mr. Windes stated this is a compromise and made motion, seconded by Mrs. Ketchel, to approve the negotiated settlement agreement and to authorize the Chairman to sign the lease amendments. Mr. Boyles commented that he does have some heartburn with extension of the lease term. Mr. Stewart noted that Destin Jet and Regal Air Destin are both 1limited 1liability companies and as of January 1, 2015 the statutes require signature to be by the *authorized member” rather than the “managing member.” He said the current documents before the Board use the term “managing member.” Mr. Stewart stated he spoke with Mr. Odom’s attorney, Michelle Anchors, and she has no problem if that language in the agreement is modified and she will ask Mr. Odom to initial it. Mr. Windes amended his motion to include this provision. Mrs. Ketchel confirmed her second. Mrs. Ketchel pointed out Mr. Odom has just arrived and asked if he wanted to speak. Mr. Odom stated the lease does not extend the term an additional five vyears but 1s a correction of incorrect math in prior lease documents. He explained the lease was to be started at the date of professional occupancy which was 2009 not 2004. The vote was taken on the motion—4 yeas, 1 nay. (Mr. Boyles voted no.) FACILITIES MAINTENANCE - DESIGN CONCEPT FOR RENOVATION/ADDITION TO CRESTVIEW COURTHOQUSE Mr. Don Turner, Facilities Maintenance Director, stated he spoke with each commissioner on the proposed changes for improvements to the Crestview Courthouse. He said representatives from Ajax Building Corporation and Sam Marshall Architects will make a March 3, 2015 -10- Minute Book 72, Page 190 Okaloosa County Board of County Commissioners presentation and at the conclusion he will ask for Board direction. Mr. Jay Smith with Ajax Building Corporation stated he is joined by Allen Wooden and James Penrod, also from Ajax; Brett Dodd, the justice specialist from RQAW Consulting Engineers & Architects; and David Alsop with Sam Marshall Architects. Mr. Alsop stated the first group meeting to discuss renovation and improvements to security and access of the Crestview Courthouse were held in June 2014. He described the monthly progress for defining the project, outlining space allocations, preparing the program document, preparation of concept drawings, followed by the schematics and cost estimates. Mr. Dodd stated the team began with no preconceived ideas. He began with an analysis of the existing structure and reviewed a series of slides entitled Existing Space Evaluation: Space Utilization Diagram. An evaluation of the current caselocad for each division was provided and a projection of the caseload given through the year 2034. Also taken into consideration were population projections, as well as staff and space needs for future vyears. Mr. Dodd told the commissioners that in twenty years they will need twice the current space they have in the Courthouse. He said Concept “A” makes the most sense with expansion to the north of the current building. Mr. Dodd provided schematic design images of each side of the structure. The proposed design includes a three-story, on-grade addition. The exterior of the structure will be similar to the Courthouse Annex Extension in Fort Walton Beach so it could be easily identified as a
